It will never be conceded, not in our lifetimes. And there'll never be a legal body empowered to adjudicate it.
But if you were to even watch a real session on video you would call it torture, by definition and in reality.
There have been cases of heart attack, stroke and broken bones on the board.

Warner Springs/North Island employed a particularly vile form of the waterboard. And the waterboard is now banned in ALL US Military training as they know it does permanent damage to everyone who is subjected to it.
When I was on the board in 1978 they didn't even think about such things. In fact, I was not given the opportunity to capitulate. I was boarded while another man was forced to watch and asked questions.
BTW...Waterboarding permanently rewires your brain. Permanent.
I have no problem with that if it saves lives.
I fully support the use of boarding when fighting these Islamic Fascists. Or anyone else who does not follow the Rules of War.
I would be HAPPY to apply it myself.
Though I'll never forget what the SERE trainer told me in a 1 on 1 interrogation: "Don't think you special or damaged just because you were on the waterboard. Those of us who apply it suffer far more psychological damage and must rotate out every 18 months. We are under monthly psychological evaluation and treatment."
