Tracy Morgan sues Wal-Mart for crash that killed 1

TRENTON, N.J. (AP) — Tracy Morgan has sued Wal-Mart over last month's highway crash that seriously injured him and killed a fellow comedian.

The lawsuit, filed Thursday in U.S. District Court in New Jersey, claims Wal-Mart was negligent when a driver of one of its tractor-trailers rammed into Morgan's limousine van. The complaint claims the retail giant should have known the driver had been awake for over 24 hours, and that his commute of 700 miles from his home in Georgia to work in Delaware was "unreasonable." It also alleges the driver fell asleep at the wheel.

"As a result of Wal-Mart's gross, reckless, willful, wanton, and intentional conduct, it should be appropriately punished with the imposition of punitive damages," according to the complaint.

Well, I guess that is why they have horse races, Seven... as more than one opinion justifies them.

Still, I have never, ever laughed at anything Tracy Morgan has said or done... in anything I have seen him in on television. I must admit I do not see him much as I have learned to look elsewhere to please my twisted sense of humor.

I also do not find anything comical at all in most recent TV Sitcoms such as "New Girl" or "Brooklyn Nine-Nine" that the mass media keep telling me are 'hilarious, laugh out loud funny!"

Of course, I can plead old age as I was brought up on television comedy in the 1950s, 60s and 70s when comedy writers actually earned their money.

However, I am not a Golden Age of Television snob as I thoroughly enjoyed and laughed out loud at the zaniness of "Seinfeld," the quirkiness of "Friends" and today's science vs. reality of "The Big Bang Theory."

But I shall go to my grave firm in the knowledge that 98% of today's TV Sitcoms... and so-called hip comedians like Tracy Morgan are witless and lack any funny bone at all--

Where at the end you'd find:

I don’t think this is equivalent either, since the truck driver is paid to actually drive a truck, and wasn’t just commuting to work.

I was just trying to fix the example given, not make it a good example.

The plaintiff here alleges that the driver didn’t get any sleep before reporting to work. I do not know how any employer can be held responsible for this unless there was some visible impairment that should been apparent to managers when the driver clocked in.


And if he were coking up before work? You can’t smell that.

It isn’t about the details of what might have caused the driver to mess up. Clearly there was a fault to this accident and it seems apparent it wasn’t the limo driver. It appears it was the Wal Mart driver. And since he was on the clock, Wal Mart is responsible, period.

And this case is not an example of litigious society, though there are millions of them all around.

In your example, driving to work is outside the scope of the bank teller's employment and the bank teller was not acting as an employee of the bank she he/she ran the stop sign.

A semi driver employed by WalMart, on the clock for WalMart, driving a semi for WalMart, is acting with the scope of his duties as an employee of WalMart.

My initial gut reaction was that this was just another litigation happy plaintiff. After giving it a few minutes I can understand if Walmart is sued.
Give this some thought: What if the driver ran over a five year old girl on the way to church?

In regards to his 13.5 hours, nobody here can say how much of that was behind the wheel. He may have been under the limit and he may have not. If he was that hard-charging, willing to drive 700 miles to do to a job, do you think there might be the possibility that he was also that hard-charging as to how many hours he would spend behind the wheel?

Ultimately it will be the judge who hears the case and it will be he who has decided whether or not Wal-Mart played a role in the crash.

For the record, I didn’t like “Friends.” I especially didn’t like it when it was being used as political/culture war propaganda to further the gay (”marriage”) agenda.

As for Tracy Morgan, the funniest bit I recall him doing was when he dressed up as Bubba’s secretary Betty Currie and slow danced to Aretha Franklin’s “Chain of Fools” on SNL.

I’ve never heard him do stand up before, listening to a little now, vulgar sex stuff.

He was okish on SNL, from what little I remember. He’s no Eddie Murphy, Richard Pryor, Dave Chappelle, or even Martin Lawrence.

I didn’t find “30 Rock” to be very funny. His brand of humor is weird to me. Random, disjointed, I’m not sure what word I’m looking for. According to Wikipedia he was once a failed crack dealer, I’m not shocked.

I think he’s offbase suing Walmart. Frivolous lawsuits won’t bring your friend back, Tracy. I hope he gets better though, it doesn’t sound like he’s in a good place mentally.

I like “The Big Bang Theory” too, it’s the only current network sitcom I watch.
