WASHINGTON Speaker John A. Boehner announced Wednesday that he would introduce legislation next month allowing the House to sue President Obama over his use of executive actions.
In a letter to lawmakers, Mr. Boehner expressed concern with what he and many in the Republican conference considered the presidents unconstitutional overreach.
The Constitution makes it clear that a presidents job is to faithfully execute the laws; in my view, the president has not faithfully executed the laws, Mr. Boehner told reporters. And when theres conflicts like this between the legislative branch and the administrative branch its, in my view, our responsibility to stand up for this institution in which we serve.
Representative Nancy Pelosi of California, the Democratic leader, called Mr. Boehners move subterfuge, and Josh Earnest, the White House press secretary, said that it seems that Republicans have shifted their opposition into a higher gear.
Frankly, its a gear that I didnt know previously existed, Mr. Earnest said. The fact that they are considering a taxpayer-funded lawsuit against the president of the United States for doing his job, I think, is the kind of step that most Americans wouldnt support.

Hey Boner, how about you pass a bill invalidating those EO’s?
The previous 12 KNOCK-DOWNS of Obama by the US Supreme Court weren’t a waste of time.
I don’t think making it THIRTEEN would be a waste, either.
Will this really happen?
I do believe that’s what this court action would be about - with the US Supreme Court striking down Obama’s ability to do so by trampling on the Constitutional prerogative of the US House of Representatives.
It is pointless.
A lawsuit is asinine. The Congress can curtail the executive branch and even abolish whole agencies and departments. The court will tell them to do their job.
The US House of Representatives will vote on it making it so that they have “standing” as a “body”. If they agree and pass it ... then it will happen. I believe they do have the votes to make it happen.
He knows Reid in the Senate would never consider such a bill. This is just another waste of time, as is his lawsuit against Obama.
The 2 options - impeachment & the power of the purse - that could rein in Obama’s imperial presidency NOW, Boehner isn't doing.
Impeachment proceedings would keep Obama so busy for months it would limit his ability to do further damage to this country. I believe it would also put his arrogance on full display for all to finally see.
As for the purse, cut off the budgets of his 2 favorite bullies - the Justice Dept. & the EPA. Shut them down. Refuse to fund them in the upcoming budget until the IRS emails reappear & Holder resigns.
This country can do nicely without the brand of justice Holder serves, so nothing lost there. Similarly for the EPA, nobody is gonna die from any increases in CO2 emissions or wildlife found dead in dry runoff ditches.
If that doesn't get Obama’s attention, then in the next budget stop the funding of other federal bureaucracies - IRS, NRLB, HHS, ....
Obama cannot make the House fund ANYTHING. It just takes 218 honorable, patriotic Congressmen to stop his agenda COLD.
Well then you better think again. By the time it reaches SCOTUS Obama will be the King of Kenya. It won’t make a damn bit of difference and it just distracts from the IRS scandal which is resonating across all party lines.
suing Obama is stupid. The House writes the budget, they could easily curtail these things if they had the political will. The GOPE has no political will to actually do anything.
Sorry to say and perhaps I'm just a bit more cynical, but this is nothing more than a political dog and pony show leading up to the elections in the fall.
The remedy for an out of control executive branch is impeachment. A law suit would likely be tied up in the courts for years and a decision would likely come well after obozo leaves our house.
Constitution subscribes impeachment.
The whole purpose of a lawsuit or any thing else is to make it appear that they are actually doing something.
Nothing will actually happen.
It is all smoke and mirrors.
I’m not saying this “out of the blue” ... but from the real facts of TWELVE US Supreme Court decisions, already, against him. Now what if all of those twelve court cases had listened to people saying, “it’s not going to do any good!” There IS a track record already.
As far as Impeachment is concerned, that is the ultimate Constitutional provision, but we’ve got a track record on that, too. The most recent example is Clinton and although there was Impeachment, it went ABSOLUTELY NOWHERE after that. The Democrats would not convict. And you can bet the Democrats are not going to convict with Obama either.
Another aspect of the Impeachment process is that it has NEVER ONCE in the ENTIRE HISTORY of this country resulted in this process removing a President from office.
SO ... compared with 12 US Supreme Court decisions slapping down Obama already - with - Impeachment and it’s record of NEVER ONCE WORKING ... I’ll stick with the US Supreme Court cases ... :-) ...
12 US Supreme Court decisions slapping down Obama - one just a few days ago - is not smoke and mirrors ... :-) ...
The budget has to go through the entire Congress, while this case only has to be done, and exclusively so, in the US House of Reoresentatives.
and the courts will laugh at them. The Congress can limit and rescind these EO’s and it hasn’t even tried.
You’ve made a mistake here. This is just for the US House of Representatives. That’s why it will go through ... the Senate is not involved.
In terms of Impeachment, you can see Post # 32”... as far as it’s track record.
The Congress includes the Senate and that’s the problem. This case doesn’t involve the Senate and it can go ahead without them. There’s the difference.
Remember, the US Supreme Court wasn’t laughing for the last 12 cases where they slapped down Obama, and that include some just this week, a few days ago.
This can very easily be another one, except this one will be more drastic than the others in limiting Obama.
How much did those other twelve US Supreme Court cases slapping down Obama distract you (or others) from the IRS scandal? ... :-) ...
They don’t follow the Constitution.
They don’t follow the law.
What makes me think they are going to follow what SCOTUS says?
Can you show me where any one of those 12 US Supreme Court decisions against Obama was not followed?
