As a federal employee I know for a fact that there are digital copies on an email server somewhere. Emails go from the computer, to the email server, then to the recipient. That email server keeps copies of them. Somewhere there are copies of those emails, and Obama and his cronies are stalling until they are all destroyed.

Help me understand something....If the IRS backed up files even for just 6 months, how is it that the files on her hard drive were not recoverable from the backup and then able to be placed on her new hard drive? Isn’t that the purpose of a back up? Or did she wait 7 months after her hard drive crashed to report it?

OK - Enough. It’s time for the American people to not pay taxes until: Lois Lerner produces the emails or she goes to trial for destroying evidence.

The border is secure. Repeal of Dreamer Act. All the invaders are deported.

Repeal of Obamacare.

Benghazi questions are answered.

A conservative lawyer could draw up a solid document that spells it out. The government is out of control and it appears that it’s up to us to restore it.

Who can file RICO charges against this administration, or parts thereof?

For years, my total understanding has been...

ANYONE.

Standing is not an issue.
The question then becomes... who or what group has the resources to file and protect themselves (physically?)

And what can the rest of us, as ordinary citizens, do to help?

“The IRS retained the legal obligation to retain paper copies of documents.”

Not sure why you think you know what no one else does....
So you work for the IRS or Sonasoft?

IF YOU PAY SOMEONE TO BACK UP YOUR DOCUMENTS WITH A CONTRACT, THEN THE OBLIGATION IS THEIRS IF THE CONTRACTS READ THUS....WHICH WOULD MAKE SENSE.

Now I’m done with this subject....move on...

Look at this way, if the other six who “lost” their emails did it on purpose in conjunction with Lerner, then isn’t that a conspiracy?
And wouldn’t a RICO lawsuit be applicable?
Racketeering In Criminal Organization indeed!

That it's a conspiracy is now beyond question.
Forget impeachment for now. The potential undiscovered evidence will be unassailable. Civil and criminal RICO charges will be the first step in cleaning the stables.

Resigning is increasingly becoming a futile alternative.
And as for "pardoning" himself and the thousands of co-conspirators, it must be made clear, now, that is not a viable option.

The most remarkable part of this sordid mess is that out of so many co-conspirators, not a single honest citizen, the key whistleblower, has emerged.

I say, confront Obama with impeachment and/or criminal prosecution and deal with the backlash as it comes

Speaking for myself, there is no backlash big enough, or nasty enough not to accept as the price of keeping our Freedom, our country and our history.

The remedy must be ruthless total and swift.

Let it come.

soetoro is just sticking his middle finger in America’s and the Republican’s face, saying “What are you going to do about it?”

There is famous historical line about legality --- "the Court has made it's decision, let them enforce it."

If Omugabe goes there, that will be the signal that all reasonable legal and moral options for the citizenry have been exhausted.

Isn’t it likely that a substantial portion of the most damning e-mails were never in official government accounts, but were sent on private accounts on personal smart-phones, laptops, etc.?

There are entire books written about this. It began in earnest during the first Rapist's regime, together with his woman, Co-First rapist Hillary Cankles.

It is because close to half of the voters in this country do NOT pay taxes, so why should they care.

Exactly.
For them, it's not just ensuring the survival of the Incompetent Great Impersonator--- it is a final desperate fight for their own survival.

Without the myriad handouts from "producers," as national pets, their survival is definitely at great risk.

If I send an email it first goes to my ISP (server) who keeps a copy and sends it on to another ISP (server) who then also keeps a copy and it is delivered. There should be copies on two separate servers and are not each server not backed up on a regular basis?

CC

NOTE: A FUNNY THING HAPPENED ON THE WAY TO THE COURTHOUSE: MENS REA, DOCUMENT DESTRUCTION, AND THE FEDERAL OBSTRUCTION OF JUSTICE STATUTE.
JUNE, 1992
67 N.Y.U.L. Rev. 570

Author JOSEPH V. DE MARCO *
Excerpt

INTRODUCTION

Section 1503 of the federal obstruction of justice statute 1 is one of the most powerful tools available to a prosecutor. 2 In the past, it has been used to punish an extremely wide range of behavior, including witness tampering, bribery of court personnel, perjury, document destruction, and attempts to mislead the government.

Yet despite the broad range of acts that fall within its bounds, a critical element of the offense of "obstruction of justice" remains obscured by Congressional silence and confused by judicial interpretation. Although one might presume the crime to require a purposeful frame of mind, the mens rea 4 requirement has never been clearly articulated. 5 This ambiguity has lead to a deepening rift between the circuits on the proper mens rea requirement for criminal obstruction of justice.

This Note argues that the mens rea requirement articulated by the Fourth Circuit in United States v. Neiswender, 6 and adopted by the Second, Fifth, Seventh, and Eleventh Circuits, is inconsistent with § 1503's legislative history, the Supreme Court's decision in Pettibone v. United States, 7 and the mens rea requirements in analogous areas of law. Furthermore, this Note argues that the Neiswender doctrine, if carried to its logical extreme, could permit criminal prosecution of conduct which amounts to little more than negligence.

Part I discusses the obstruction of justice statute, examining both its legislative history and the conflicting judicial interpretations of its mens rea requirement. Part II focuses on the ...

How could a modern company depend on a hard drive for email backup? Have they never heard of servers?

Our ignorance of things technical, computer-wise, is part of the problem.

"Servers" are just sets of hard drives, physically and electronically connected and "stacked" as an array.

The only exception are tape backups, still a most efficient and reliable form of backups, but nevertheless also vulnerable to funny business by dedicated criminals.

This smarmy, arrogant criminal clown will forever live historically, as the Omugabe regime's version of Baghdad Bob.

Wish I knew how to do photoshop, to make that image complete by putting prison bars in the foreground.
I can't think of an appropriate sentence for his actions/attitude, short of hanging.
