California lawmakers are considering a measure that would allow the state to distribute condoms to prison inmates, an attempt to cut down on sexually transmitted diseases and HIV, although sex acts between inmates would remain unlawful. Reuters reports the bill is advancing in the Senate it already passed the state Assembly and would direct state officials to set up a five-year plan to hand out condoms throughout the states prison system. We are not only advocating for the improved health of prisoners, the bills sponsor, Democratic Assemblyman Rob Bonta, said. But we are also protecting communities across the state that could potentially be harmed by communicable diseases when former prisoners relocate to neighborhoods upon re-entry.

So long as prison authorities can’t protect every inmate from forcible rape, then providing condoms is reasonable.

Yes, I’d venture that few prison rapists will use the condoms. I am saying that, if all the stories are to be believed, prison authorities have failed miserably in carrying out their duty to prevent prison rapes. The least (and I do mean the least) they can do is attempt to protect the rape victims from being infected with deadly diseases. This isn’t about condoning the actions of the rapists, it’s about protecting their victims. Issuing condoms is a start, albeit probably largely a symbolic start. If you were to suggest dickerectomies for prison rapists, I wouldn’t be likely to object.
