Justice Sotomayor and the affirmative action bitter-enders have lost bigtime(Warning-graphic image)

The American public has woken up to the folly of trying to end racial discrimination by practicing it, dooming affirmative action to a slow death, and the racialist left is not taking the news very well. That is the only conclusion to draw from the extraordinary dissenting opinion yesterday by Justice Sonia Sotomayor in Schuette v BAMN, the case in which the Court upheld Michigan’s law outlawing racial preferences in state-funded higher education. Sotomayor took the unusual step of reading the dissent aloud from the bench, indicating her vehemence.

Justice Sotomayor’s dissent was actually longer than all the other opinions in the case combined, so that reading took a while. But she was faced with a difficult task in explaining why refusing to treat races differently is actually racial discrimination, so of course she need a lot of verbiage, background, and pretzel twisting.

Four aspects of her argument stand out:

She attempted to re-brand “affirmative action” as “race-sensitive admissions.”

“Although the term “affirmative action” is commonly used to describecolleges’ and universities’ use of race in crafting admissions policies, Iinstead use the term “race-sensitive admissions policies.” Some comprehend the term “affirmative action” as connoting intentional preferential treatment based on race alone—for example, the use of a quota system, whereby a certain proportion of seats in an institution’s incoming class must be set aside for racial minorities; the use of a “points” system,

Sotomayer is a brick for sure and Obama is an incessant narcissist but short of raping and killing others I wouldn’t begrudge anybody for getting a better education than most.

Yes I can. If Hillary is elected and or we don’t take the majority in the Senate we will.

Ginsberg is senile. I wonder why she doesn’t step down (though I’m glad for it — until she does). It used to be Ginsberg never rubber stamped anything. Now she can only agree and perhaps an intern or two vocalize their imagined interpretations.

Affirmative action assumes that specific groups ARE inferior, because they cannot otherwise achieve demographic proportionate merit based admissions and achievements.

Not meaning to be cruel but when the careers, writings and real accomplishments of Sotomayor, Obama and Holder are examined, they are the prototypical case studies of affirmative action. It pads statistics and assuages white guilt but almost nothing worthwhile is achieved.

Well written post, especially with a few edits. :-)

The reality is that minorities should welcome the end of AA. As it is, the truly competent minorities who obtain significant achievements often don't get the respect they deserve because it's assumed they are less qualified folks who got there through affirmative action.

Sonia knows that she's inferior and the only way she could ever become anything other than a cleaning lady is if people with far more intelligence and talent than she has are hogtied and left by the side of the road by the legal system.

It ran to fifty-eight pages I understand. Sotomayor and obama show the folly of affirmative action and the damage such policies cause when such people attain positions of power.

Sotomayor is affirmative action personified. She rose through her legal career as an attorney, then as a judge, because she was a “wise Latina”, to use that term she has used. If she were white, she would not be on the Supreme Court today. Her career would not have sent her on such a path.

Perhaps her dissent was so strident because for her, it’s personal.

Yet she doesn’t acknowledge the other side, namely, that with benefits given to people such as her, that someone else more deserving was denied those same benefits. After all, there are only so many slots available in college, in law firms, on federal courts, and on the Supreme Court. By definition, a less qualified person such as herself pushed out someone else more deserving.

Affirmative action may have made sense in 1965, as we were then coming out of a time when there was open discrimination.

But it seems clear to me that, even if for sake of argument, it made sense in 1965, that we still have liberals who think that minorities need special help forever. Some liberals talk as if it still is 1965, and Jim Crow laws are holding people back.

Yep, it’s an automatic “reverse discrimination” circumstance. Considering universities, where there’s only so many admission slots available, if you admit somebody *because* of color you’re, by definition, not admitting somebody because of their color.

Just because there’s more of one color than another currently isn’t something that can be legislated into “correctness”.

Justice Antonin Scalia charges that Sotomayor's approach "promotes the noxious fiction that, knowing only a person’s color or ethnicity, we can be sure that he has a predetermined set of policy 'interests,' thus reinforcing the perception that members of the same racial group—regardless of their age, education, economic status, or the community in which they live—think alike, and share the same political interests.”

Ugly in both mind and face, so true.

Sotomayor is clearly unfit to be a member of the highest court of the United States. She is the perfect example of why it is wrong to give preferential treatment to individuals based upon the color of their skin. Unfortunately this deliberate ‘mistake’ of appointing her to SCOTUS will have the desired effect for this socialist/fascist regime, of keeping rascism and fraudulent rulings on life support for decades to come.
