The suit was all about spin.
They needed to create the narrative that the vote was tainted. They needed to show that they were not going to stand for losing. Now that the news has died down they do not want to go to court and have it proven they are not wanted.
Losing two times would be a major blow to their leadership jobs.

More likely that pursuing the appeal at this time would hamstring Democrat attempts to make electoral inroads in the South with candidates like young Miss Nunn.

Good point..I suspect that the NLRB wanted to rule for the union, but someone pointed out that the federal courts would toss it out..
Also..isn't the whole question of the legitimacy of NLRB rulings in question because of Zero's "recess" appts? what's happening with that..
