Andy Barrie recently held a property rights seminar for landowners. Asked what lessons they shared, Ceil Barrie said with teary eyes, "Yeah, don't annoy the government."

I’d run for office and then take the peoples homes who were behind this. At the least.
"To me, what just came out of it is, you can't win, you can't fight the government," landowner Ceil Barrie said Wednesday.
She and her husband, Andy, owned ten acres of land perched at 11,000 feet elevation in Breckenridge. The property, with breathtaking views, was a private patch of land surrounded by White River National Forest.
An old, uninhabited day-use cabin, an outhouse and a shuttered gold mine sit on it. The Barries legal troubles began when they worked to access their personal paradise with a utility vehicle. They traveled on an old mining road dating back to the 1880s and said the county did not even know about the road until they made them aware of it.
The county asked to buy the land, but the Barries did not want to part with their piece of "Colorado heaven."
So Summit County condemned it, filed for eminent domain and petitioned for immediate possession.
At a bare minimum, I’d leave behind a stack of leaking car batteries and broken mercury thermometers ... and a flaming pile of old tires. It would be a long time before anyone called it the White River National Forest again.
IMHO this is a much more outrageous case than the Bundy ranch situation. These people didn’t owe the government money, and did nothing to give them any kind of claim to take their property. Just greedy government and eco-Nazis teaming up to rip off honest citizens.
They had a crap or collusive lawyer to lose that.
Also, they should have kept their mouth shut about the road, though if it was through the national forest they could claim it was utilized as a prospecting road.
Ya see, the first bureaucrat that raises a stink in a case like this, needs a baseball bat upside the head.
EPA, BLM, IRS, HHS,.....Just to let them know that there’s a price for their utter stupidity. That would slow down some of this nonsense.
And....even if it resulted in a ban on baseball bats....there are an infinite number of substitutes, so as to make the ban irrelevant.
Eminent domain can only be used to acquire land for a public need. And you have to be paid fair compensation for what the government wants.
Remember Kelo?
They can take your property for a K-Mart because it pays more tax, according to SCOTUS
As government gets fat and more arrogant, what it is willing to call a “need” grows beyond credulity.
My cousin lives on the edge of a national forest in Arkansas. There are roads all through it. He drives back there all the time. They allow no atvs but horses and trucks are just fine. I don’t get it either.
Because the Federal Govmint doesn’t own enough western states land, apparently.
This is Colorado where the leftists control a lot of local governments and the Governorship.
Time for more recalls, more challenges to asshole judges (at least this guy was honest about the situation), and more candidates for local government positions who espouse property rights. Should run on the “Sanity Party” ticket.
It would be interesting to follow this story into the future to see just what does happen to that property Summit County just stole from the Barrie family.
I’d bet someone of the Summit County elite will end up with it, either by purchase, or some form of lease.
I know Breckenridge well since I have family living there. The sad truth is that this is like a poor man’s Vail. It is ski town and tourism runs the businesses. Many sandal wearing 60s types moved into the area years ago and managed to build up their influence in the local political scene. Remember that South Park (the cartoon) is based on Breckenridge and you will understand exactly how this happened
What if I was willing to pay the tax the Gov expects to receive? Then what is the basis for the taking? This goes against all the logic of private property ownership - but what if??
Acting out all their bitterness against folks who had nothing to do with their childhood anger problems.
That's what we learned in school. That's not how it works anymore in our Brave New World.
The breauracry will just out lawyer you with taxpayer money and keep it going until they find the 'right judge' who wants to get promoted to a life-time federal job.
Boss Tweed was a small-time hustler compared to these big-time breaucratic thieves we suffer through today.
Lesson here is don’t tell the gubmint bout nothin.
Now we should tell people “on our
side” who sided with big government
against Bundy what is at stake.
But they won’t listen.
