As Many As One Million Armed New Yorkers Are About To Break The Law
Forbes ^ | 4/13/2014 | Frank Miniter

This year April 15 is more than the tax deadline for an estimated one million New York State residents. It’s also the deadline to register “assault weapons” and “high-capacity” magazines. If they don’t, they’ll begin living outside the law. A lot of them have decided to do just that. They’ve decided to practice civil disobedience even though failure to register an “assault weapon” by the deadline is punishable as a “class A misdemeanor,” which means a maximum sentence of one year in prison.

I put “assault weapon” and “high-capacity” in quotes because their definitions vary by state—they’re political terms. In New York State, the SAFE Act passed by the legislature and signed by Governor Andrew Cuomo in January 2013, uses an expansive and elaborate definition of “assault weapon” that includes a lot more than AR-15s. Now even a semiautomatic Remington Model 1100 shotgun—a popular shotgun first made in 1963 that is used by millions of hunters and skeet shooters—is an “assault weapon” in New York State if the shotgun has a pistol grip. Many other commonly owned pistols, shotguns and rifles are also now labeled “assault weapons” in New York State.

When I asked the New York State Police how many New York gun owners had registered the guns they own that now fit somewhere into the state’s expansive “assault weapons” category the state responded: “New York State Police cannot release information related to the registration of assault weapons including the number of assault weapons registered. Those records you seek are derived from information collected for the State Police database and are, therefore, exempt from disclosure.”

This is the same dilemma Connecticut gun owners found themselves in at the end of 2013. As of December 31, 2013, according to Lt. J. Paul Vance of the Connecticut State Police...

In NY they will do this very gradually.

Whenever you are stopped for anything by the police, they will check to see if you bought an “assault weapon”, and try to enforce the SAFE act.

Whenever you do anything related to taxes or vehicle registration, they will check.

Any interaction with the state will result in a check regarding “assault weapons”.

They will probably do things like deny vehicle registrations until you turn in your illegal weapons, or satisfy them about your weapons.

It will be a very gradual process, not an all at once move.

“It will be a very gradual process, not an all at once move.”

I met an investor who sold is business and moved out of New York. He said, “I’m not giving up my guns.” So, he moved his sizable fortune to Florida where he’s busy buying property here instead of there.

Bennington was the biggest militia action of the entire Revolution ..... Burgoyne won, but it sure put a limp in his swagger, and he promptly lost the whole campaign at Oriskany a few days later.

Maybe Burgoyne shouldn't have screwed with 'em at Bennington.

New York Officials Argue for Flexibility with Gun Law Violators… As Long as They're on the City's Payroll

Preet Bharara won't rule out ethics probe into Gov. Cuomo

FReepmail me if you want on or off my New York ping list.

IMHO, this could mean almost 1 million new voters against Cuomo in particular and moonbats in general. We'll see.

That’s One Million votes against Cuomo

I think it will be a mix of newly registratered voters and a return of single issue Second Amendment only voters. Rats had a lot of people fooled since there hasn't been many serious attempts at gun grabbing in Congress since 2006 when the rats took Congress until Newtown, CT. Rats could lose Congressional seats in upstate NY. Similar seats in CA, CO and CT should bear watching too.

And people like my son headed for greener, more patriot and gun friendly pastures when he graduated college.

Got a pistol permit the very first thing he did after changing his driver’s license.

Burgoyne won???????

I wonder what NH General Stark, VT General Ethan Allen, and all the NH and VT volunteers who slaughtered the Hessians and Brits at the Battle of Bennington (actually fought on a hill in NY), would think of this revelation?

Now that I think of it, I'm not sure if Ethan was there, but a lot of my cousins, great uncles, etc., were.

Still, it is a fun thought exercise. Could you imagine if the entire NY Senate / Representatives were all registered to own an assault weapon?? Now that would be political theater!

I say something along those lines to liberals/progressives all the time. It goes something like this...

I ask: “Do you really think you’ll be among the liberal elite?” (Rhetorical, the answer is clearly NO.)

Then I ask something like: “Advocating what you do, do you really think freedom loving people that surround you will let pass into this brave new world with your reputation intact? And, innuendo being as salacious as it is, who, what bureaucrat will believe you, why would they risk it?” (No and No, again rhetorical)

Then I ask: “Whom will you complain too when you or your kids are low on the list for that medical treatment, ration or whatever?” (Usually no response here as their getting pissed.)

Then I tell them: “If you complain to me I’ll nob sympathetically...figure I owe you that.”

Solid point! Since a law has been passed, the law must be followed.

They gave a year to sell, destroy or register the weapons. Now they did make the sale/transfer within NY immediately prohibited.

However, pretty simple solution to that really...

“No, officer I no longer possess the weapon, I sold it out of my car truck to a Vermonter when I was at my buddies camp in Vermont. The leaves were turn, it was beautiful that weekend. Have you been to Vermont.”

-or-

“Hey, I left it at my buddies camp in PA.”

Point being it’s not illegal for a New York State resident to transfer and/or possess an “assault weapon” outside of New York and the enforcement arm within New York has no jurisdiction in any of these places. (In other words “piss off”.)
