BOYLE HEIGHTS, Calif. -- A family that claims a woman was frozen to death in a hospital morgue after she was prematurely declared dead can proceed with a medical malpractice lawsuit, an appeals court ruled Wednesday.
"This is one of the most egregious cases you'll ever see," family attorney Scott Schutzman told CBS Los Angeles. "This case keeps me awake at night."
The California 2nd District Court of Appeal overturned a lower court ruling that the lawsuit against White Memorial Hospital was filed too late.
Maria de Jesus Arroyo, 80, was declared dead in July 2010 after suffering a heart attack and was placed in a freezer at the Boyle Heights hospital. Morticians who received her body a few days later discovered that it was face down and the woman had a broken nose and disfiguring cuts and bruises to her face, according to court papers.

Who was in charge of the wake? They didn’t do such a good job.
Vivirefrigeration ping.
Allegedly? It should be pretty easy to determine if she's dead.
The doctor who pronounced her dead needs to be banished from the practice of medicine.
Apparently not.
This is an early preview of the coming attraction of Obama-Care.This is what happens when u allow Democrats to oversee our health-care system.”Well Dr.Waxman,Patient appears to be dead,so lets just assume that the patient has died and move him into the freezer”,,and lets just wait and see how it all plays out.
A lot of people were afraid od being buried alive. For instance, Eleanor Roosevelt who asked that her wrists be opened before burial a common practice.
Didn’t we have at least one occasion when a blockhead restaurant worker locked a freezer without even checking to see if anyone was in it before he closed out the joint?
:: without even checking to see if anyone was in it before he closed out the joint? ::
Knowing several restaurant workers, the operative word in you observation is
“joint”
Obamacare would definitely approve, but wouldn’t they require the freezer be run with green energy?
was the surgeon/physicians name “Barry” by chance?
+1
Tax-chick and I having been keeping up with the vivisepulture theads this year. We've had four, and this thread doesn't count because the woman wasn't buried.
This morning, we had our first anthropodermic bibliopegy thread of the year.
The way the world is going, there will probably be more.
You should consider listing all four!
Obama Care Death Panel - a morgue freezer.
We don’t seem to have been using a “vivisepulture” keyword.
She should have had a wooden stake driven through her heart.
