Call it the biggest Facebook mistake ever. A daughters snarky status update has cost her father the $80,000 settlement he won in an age-discrimination lawsuit.
According to the Miami Herald, Patrick Snay, 69, was the headmaster at Gulliver Preparatory School in Miami for several years, but in 2010, the school didnt renew his contract. Snay sued his former employer for age discrimination and won a settlement of $80,000 in November 2011. The agreement contained a standard confidentiality clause, prohibiting Snay or the school from talking about the case.
However, Snays daughter, Dana, now at Boston College and a part-time Starbucks barista, couldnt resist bragging about the case on Facebook. Mama and Papa Snay won the case against Gulliver, she wrote. Gulliver is now officially paying for my vacation to Europe this summer. SUCK IT.
Dana has 1,200 Facebook friends, many of whom are current and former Gulliver students, and news of the post made its way back to the schools lawyers, who appealed the verdict. The Third District Court of Appeal tossed out the $80,000 settlement earlier this week. Snay violated the agreement by doing exactly what he had promised not to do, Judge Linda Ann Wells wrote. His daughter then did precisely what the confidentiality agreement was designed to prevent.

So I guess young Dana won’t be going to Europe after all this summer.
It’s unfortunate his lawyer didn’t make it clear enough to the whole family that anybody talking about it could violate the terms of the contract.

Methinks Miss Biglips will now be a full-time barista and a part-time student. She has finally learned the first thing about actions having consequences.
Dana’s friend count on Facebook is now 1198. Both her parents “un-friended” her when they found out that Dana cost them 80k.
I think that just about says everything about the young "lady" we need to know. Hope she enjoys her summer at Starbucks.
Can they sue the lawyer?
Since when was his whole family a party to the lawsuit?
Was his daughter a plaintiff too?
I seriously doubt it.
Or was he not even allowed to disclose the results of the settlement to his own family members?

How can someone not even involved in a lawsuit be legally subject to a settlement of that lawsuit?

A quick perusal of the link to her Facebook timeline shows she “likes” “Girls” and “Ready for Hillary”. She obviously needs much more than an east coast, elite education.
So can Patrick Snay now go back and litigate the basic case, I wonder?
