Justina Pelletier’s Mother Collapses After Court Orders Daughter to Non-Medical Foster Care Facility

BOSTON,—The family of Justina Pelletier was emotionally distraught after a judge sentenced their sick daughter to the foster care system without access to her previous medical care. Justina is at the center of a legal battle between the Pelletier family and Boston Children’s Hospital over custody and proper medical treatment.

Attorney Mat Staver of Liberty Counsel filed a motion for pro hac vice to represent the Pelletiers, but the judge took the rare move of allowing the Massachusetts Department of Children and Families (DCF) to respond to the motion, effectively denying the specialist attorney from arguing in the hearing.

To keep the case under wraps, the judge ordered media to leave the courtroom and took the unconscionable step of transferring Justina’s custody to the foster care system, where she will not have access to treatment for her mitochondrial disease. Her family is deeply concerned for her life and safety.

Boston Children’s Hospital performed a controversial medical-legal maneuver colloquially called a “parent-ectomy” last year, seizing custody of Justina after disagreeing with her parents and physicians at Tufts Medical Center about her diagnosis and treatment. Since losing custody, Justina’s condition has steeply deteriorated.

After receiving the judge’s shocking decision today, the Pelletier family was heartbroken and distraught at Justina’s plight. Justina’s mom, Linda fainted in the courthouse hallway and had to be taken by ambulance for care.

“I was nearby when Linda collapsed, and it was heartbreaking,” relayed Keith Mason, Personhood USA President. “No parent should suffer as the Pelletiers are suffering. Knowing that their daughter will be cruelly and intentionally transferred to a facility that is unable to care for her medical needs is devastating.”

The only drawback to that idea is the child improves under hospital care...in this case that has not happened.

It’s unfortunate how news stories report more drama than they do actual information.

To make a decision about this story, you first have to know how the condition was diagnosed, to which the story says nothing. This is the first logical question.

From googling I find this:

“Diagnosis of mitochondrial disease can be made through a combination of clinical observations, laboratory evaluation, brain imaging, and muscle biopsies. And an experienced integrated approach is necessary – not just one test. Referral to a specialist in mitochondrial medicine is often needed for diagnosis. Rarely is genetic testing sufficient for the diagnosis of mitochondrial disease. Even with the advent of new gene sequencing techniques like Next Generation sequencing, many of the identified changes in genes require the information obtained from a muscle biopsy for interpretation.”

The reason Justina was sent to Boston Children’s Hospital was because the gastroenterologist that was previously at Tuff’s was now at Boston. They were never able to see him - when they got to Boston, some other doctor (7 months out of medical school) interceded and made the alternate diagnosis within 12 hours.

It’s obviously not Munchausen by proxy. The daughter has been away from the parents for some time now. If her symptoms were inflicted by her mother she would be cured by now. Looking at her pictures she appears markedly worse.

One of my friends was diagnosed with Juvenile Diabetes at an early age. She had to stay on a strict diet all throughout her childhood. Later, her mother admitted that she fabricated the diagnosis.
The mother admitted it after she herself was diagnosed with a disease that sent her immediately into a wheelchair. One day she was walking around town, the next day she was unable to walk ever again.

The disease is Munchausen by proxy. ... Usually, it is the mother who inflicts Munchausen by proxy ...

If that were it, the girl would be getting better, not worse, since she is no longer with her mother.

So why wasn’t a third doctor or third team of doctors brought in to review the records and examine the child?

My thoughts, exactly. Rather than put the girl at risk and her parents in such an awful situation - for over a year now - why not bring in a third party team of doctors?

Let's assume for a nanosecond (for us products of the public education system, that's not very long) that all involved want the best for the child If that is the case, why not do what's best for the child, and that is obviously NOT taking her out of her family's custody and changing her treatment.

I understand that the doctor at Tufts that first diagnosed and treated her has offered to consult with the doctor at Boston Childrens that brought in DCF, but the latter has refused. How can that be in the best interst of the girl???

Although the story doesn’t say so, my understanding is that the diagnosis was made by a doctor at Tufts who is an expert on the disease. The diagnosis at Boston Childrens was made by a newly licensed (less than one year) doctor, who apparently refuses to consult with the doctor at Tufts.

I think you’re right. Furthermore, I have heard it alleged that the Children’s doctor is vying for a grant that is for proving that mitochondrial disease does not exist. This doctor, I understand, is a psychiatrist. So it could be the motivation for this seeming injustice is pure greed.
