Hearing in Florida movie theater shooting to focus on video

WESLEY CHAPEL — A court hearing will be held Tuesday on a motion by the Pasco County State Attorney’s Office seeking guidance on the release of the surveillance video that shows the January shooting death of Chad Oulson.

The motion seeks clarification on three items. First: Should the video be released to the defense attorneys and, if so, should it be a copy or viewed under the supervision of the state.

The video depicts the shooting of Oulson and “related acts” before and after the shooting, the motion says.

The motion will be heard at 11 a.m. in front of Circuit Judge Pat Siracusa at the Robert D. Sumner Judicial Center in Dade City.

Additional sources describe the judge ordered the video turned over to the defense January 30. The prosecution has stonewalled. They were unwilling to hand over the video, claiming there are numerous hours of video and that their office is not equipped to turn around copies of the videos so quickly. FOXNews.com

Why should their be any question as to whether or not the defense should have access to a critical piece of evidence?

I have always believed, the shooter is probably guilty, (though we should wait until all the evidence is presented) but providing evidence like this to the defense should be totally routine. Makes me wonder if their is something in the video that the prosecution does not want the defense and the public to see.

The prosecution has stonewalled.

It's only been a few weeks and the hearing coming up is only the bond reduction hearing. What they did to Zimmerman was stonewalling -- this hardly.

I posted an article on this matter a couple days ago but it was taken down for what ever reason I don't know but in it the prosecution claimed that he did not need to turn it over according to Floruda law until AFTER discovery but the judge told prosecutors to muster it over to them.

Are you trying to say that maybe the ex-LEO's story doesn't match the video? What are you going to believe? Your lying eyes or the "word" of an Ex-LEO? Surveillance videos in Dallas have proven LEO reports to be false several times in the last year.

I would guess most movie theaters installed surveillance video shortly after the Aurora, CO massacre.

It tends to make you think the video either supports the defense or muddies up the State’s case.

If it supports the prosecution, and shows an obvious murder, it seems like they would have no problem releasing it.

I am trying to say that

a) Releasing the video to the defense should be routine.
b) The fact that the prosecution has been resisting releasing it to the defense make me wonder if the video helps the defense.

At any rate, in ANY case we need to wait to see all the facts before passing judgment. My initial feeling was that ex-LEO was very, likely, guilty, but I always wait for all the facts to come out.

Perhaps after we see the video we will know more.

Really??? It sounds more like the defense is opening up a can of worms that they will regret. From the article:

Finally, once videos are reviewed by defense attorneys, they typically become public record and can be requested by media outlets. The State Attorney’s Office wants Siracusa to rule on whether the video is public record once the defense views the video or when excerpts of the video are shown in court on Wednesday.

The only question is whether texting will be allowed during the showing or will anyone dare to do so.

Prosecution argued they did not have time to prepare video for the defense. However, the state is planning to use the video (or portions of it) during the defendant’s bond hearing tomorrow, Feb. 5.

One would think that would fall under normal discovery. The defense should be allowed to view the video under supervision of the court and then provided with a copy for use in developing their defense. I don’t see why their would be a question about this.

Sounds more than strange. Is this the prosecution’s first trip to the rodeo? What’s the big deal about giving the defense a copy of the video, no matter how many hours?

Don’t have info about prosecution team experience for this high profile case. Last week, the judge ordered the state to turn over the video. Attorneys for the deceased’s wife have also agreed the defense should have the video.

It’s video. It’s already prepared. The only thing you need to do is make a copy. Should take a few minutes at most.
