Judge strikes down Florida law mandating drug tests for welfare

A U.S. judge on Tuesday struck down a Florida law requiring drug screening for welfare recipients, saying that it violated the constitutional protection against unreasonable searches.

Florida Governor Rick Scott, a Republican who campaigned on a promise to expand drug testing, said he would appeal the ruling.

The law took effect in July 2011 and required parents to undergo and pay for urine tests for illegal drugs when they applied for Temporary Assistance for Needy Families, a federal-state program that helps poor people with children pay for food, shelter and necessities. …

This is absolutely crazy. How come conservative judges never get to “Strike down” laws? Are there even conservative judges?

Drug test...or force the Judge to “babysit” a HUD apartment complex. Maybe this person needs to see the abuses first hand.

Indeed. This is an agenda move. Because just like in the military, once they will not need them, all of a sudden the “tattoo standards” requirements will go up. These people are being recruited behind legal mumbo jumbo.

Funny the judge would probably say they have no second amendment right.because they are on welfare

They piece meal and load the dice as it goes along in progressivd moves towards the final picture they want to see.

I agree with drug testing and I think it’s needed to rid our society of this scourge! Even though everyone who is on these illegal drugs should rightfully be THROWN INTO JAIL RIGHT NOW ... I would agree to letting them try to get out of that scourge, by going through rehab.

OTHERWISE ... throw EVERYONE who is on illegal drugs, into JAIL, if they refuse the help and persist in this scourge!

I completely agree with your sentiment, because nothing makes LESS SENSE than mandatory drug tests in most places, for folks who earn the money they get, rather than those who embrace and abuse money from taxpaying people for doing nothing,...and NO drug test.

You know...it looks like the ship has taken on too much water.

Ridiculous ruling. For EMPLOYED, tax-paying people, we random drug test all the time. And if there's an industrial accident or injury, watch out.

Testing out the wazoo. Who wants to fly in a plane where a pilot has been boozing it up all night?

This simply ensures that people are not endangering others, by being high all the time.

If a welfare recipient is getting MY money, they better not be buying drugs with it.

It means they REALLY don't "need" welfare dollars, since they have so much "extra" to spend on booze and whatever, instead of FOOD.

So if you want to vacuum out MY wallet, play by the rules, or get your f'ing hand out of my pocket.

YOUR choice.

I’m going to assume you have had drug use in your family. Please forgive me if I am incorrect.

But it really isn’t the government that should control this unless some law is broken.

Your original statement, that I objected to, was that EVERYONE should be tested. So, you think Great Aunt Sally who is 94 should be tested?

Personal responsibility enters into the picture at some point.

Look around you ... it’s not family ... this scourge is affecting everyone around you.

And, let me remind you that the “law is broken” once the illegal drugs are bought, sold or taken. We’re already past the point of questioning “if they do something illegal”. If they’re taken the illegal drugs, it’s ILLEGAL.

About “Great Aunt Sally” who is 94 — we could probably have a cut-off age of 90.

“Personal Responsibility” means they are not on illegal drugs. If they’re on illegal drugs, they’re simply not exercising personal responsibility.

So, as a government employee, I have to take random drug tests as a condition of employment. If I fail, I get special counseling and then a second test. If I fail again, I get fired. All that is legal.

But parasites sitting around on their fat a$$es watching their taxpayer funded flat screen TVs and collecting welfare don't either have to take drug tests or even work to get a nice government pay check? That is demeaning. Have I got that correct?

Right.

I get it.

It's like getting "free" health care. Just vote yourself rich. The Liberal schemes are working like gangbusers.

This country will belong to you and those that think like you....that government control is a good thing.

Like I said...I don't agree with drug use or participate in the activity...but the day we are called enmasse to be tested will really Pi$$ (pun intended) me off and I'll look at Belize.

Welfare is not a protected right.

There are special circumstances for consideration involved, specifically due the fact that it deprives working Americans of the fruit of their labor.

It is completely appropriate that a standard is set for personal behavior before being permitted to receive money that was confiscated from working Americans.
