Cruz Legal Memo: Obamacare is 'Abusive View of Federal Power'

Sen. Ted Cruz plans to argue Monday in a legal memo that Obamacare is unconstitutional and an abuse of federal authority, according to The Daily Caller.

His memorandum, "The Legal Limit: The Obama Administration's Attempts to Expand Federal Power," will reportedly include legal citations and argues that the Obama administration's implementation of its signature healthcare legislation demonstrates an "abusive view of federal power."

According to the Daily Caller, the Texas Republican and tea party favorite uses the memo to question the U.S. Supreme Court's ruling upholding the law by noting that parts of it were found not to meet the constitutional challenge.

Cruz also argues that the administration had no legal basis to unilaterally grant a one-year delay on all Obamacare health insurance requirements or delays to the employer mandate. He also contends that the White House disregarded federal statutes to permit congressional staffers to obtain government-subsidized health care, according to the memo.

In addition, the Daily Caller reported, the senator argues that the Affordable Care Act is unconstitutional because laws that raise revenue must originate in the House and not in the Senate where he says the law originated. He also contends the law violates the First Amendment and the Religious Freedom Restoration Act because it requires religious organizations to include contraceptive coverage for employees in their health plans.

0bamacare apparently had no severability language.

If even the tiniest part is unConstitutional, Traitor Roberts should have shot it down.

The People already had Congress partly redirected by that time and the 0DontCare couldn't have passed again.

Nowhere in the US Constitution is there direction to enact health or insurance laws. If it is not in the Constitution it is a state responsibility, not a federal one.

MEMO TO FEDERAL GOVERNMENT: Get back in your bag.

Chief Justice Roberts, IMO,, Is the first Chief Justice that was successfully blackmailed by a sitting President.

His decision single handedly destroyed the Constitution.

I am giving him the benefit of the doubt by saying he was blackmailed, because if he wasn’t he is ignorant of what is written in the Constitution.

No way can the Constitution force Americans to buy a product they do not want and be forced to pay a fine OR a tax for not buying it.

Cruz is on a mission to protect and restore our Constitution, he is one of a very few, but no one fights as hard as he does.

It is so sad to see how quickly conservatives are willing to shoot there wounded, and throw him under the bus over mandela, what comments have nothing to do with his mission.

He is after all a politician, and at some points he will do that which is purely political, a major weakness in the conservative movement is the demand to be absolutely perfect all the time, and so in the end we lose.

I read on another post how disappointed freepers are in Cruz, well I’m disappointed in those freepers, and it is sad to see so many of them.

Congress should initiate an investigation into what the Obama administration did to illegally influence or blackmail Justice Roberts into making his insane decision upholding the ObamaCare law.
