Family returns home from funeral to find stranger has moved into their house

A family Ohio were in for a nasty surprised after they returned from a visit out-of-town visit to a dying relative to find someone else had moved into their house. Their outrage has now turned into a court battle, pitting them against a man who says he has the court documents to prove the house is now his. Robert Carr moved into the home that had been occupied for 21 years, changed the locks and emptied the house. Scroll down for video... When the family confronted Carr, he showed them a document he filed with the the County Court. It's called a 'quiet title' and lays claim to the property because Carr says the family abandoned the house and gave up all their rights.

The family members have said they are too afraid to be identified. 'What he's looking for is full title and ownership of the home,' the family's attorney, Alison Warner, said.

Carr expects to pay nothing to keep the home. 'He's in their home. They don't know when he's there. He can be there now,' Warner said. WLWT has uncovered 11 other instances where Carr has filed the same paperwork. Seven of the cases were filed on the same day. 'When you abandon a property and don't want anything to do with it, somebody can come in and take it,'' Carr WLWT. 'I have a team of people who go out and I say make sure the house is empty. If it's empty, change the locks,' Carr said. 'Anybody can do it.' The family from Springfield who don't want to be identified say they feel violated. 'I'm very scared, you know, because I never know if somebody's going to be here,' the homeowner said.

I have recounted a few times on FR how I had a car stolen from me, the thief *admitted* to the police that he had taken the car without paying for it, and how the cops refused to do anything about it because the thief had a copy of the title in his name. The title was FORGED (another crime), but at that point the cops told me to try taking him to small claims court. They actually threatened to arrest me unless I left the police station - and I wasn’t making a disturbance, only asking to see their supervisor.

make it look like it’s abandoned and wait till he comes in.

You see ... that’s the thing ... once someone has “something” that is “paperwork” showing something different than you claim — at that point, the police are not going to do anything except to tell you to go to court.

Shooting him in the street and not on your property will get you arrested for murder right quick. Shortly before I met my wife she was being stalked by an old boyfriend who tried on several occasions to kill her. She and her son had a car alarm installation business and had a pistol/right to carry permit. The local police knew the guy, had several run ins with him and were anxious to get him either in custody or in the morgue.(cops aren't always the bad guys). They told her above all else wait until he's on the property or in the house to shoot him because if he's any where else or his back is to you the judge isn't going to by the ‘’self-defense’’ argument. As it turned out he broke into her apartment. She told me she picked up the gun(a .380 automatic) but her hands were shaking so much she couldn't aim straight. A-hole saw the pistol pointing at him and did the fastest pack peddling out the door in history and she never had a problem with him again. Pal, you sure have chosen a good screen name for yourself I must say.

That is my take. I’d simply explain to him, “Bull Shit. Ever heard of Pascel’s wager? Here is my version. You leave, you win and I win. You don’t leave, you die and I either get off for shooting an intruder or go to prison. But either of those two mean you lose no matter what happens to me.

I worked hard to get my home. And I will be dead or in prison before I let someone like that do this to me.

It seems that the issue is between the mortgage holder and this guy in the house. Those other people (who were in there before) are out of the picture since they had been foreclosed upon.

There was some arcane law on the books in Texas that said if a piece of farm land was listed (preparing to be planted or planted...even if it was in sunflowers) that property belonged to the planter.

My very kind MIL allowed a prospective buyer to go ahead and move in prior to closing the deal and got caught in this trap.

She could have been caught in court for years and spent a ton of money in legal fees. Fortunately..she had a very brave and redneck son that skipped over the middle man and booted the grifters out on their heineys. He also had the unspoken support of the local law enforcement on his side. And they lost the planted crop. :) I love West Texas justice. :)

This was in the 70’s. Not sure if that law is still on the books.

Catch this guy by himself. Bring along your two friends,
Smith and Wesson. Convince him to sign a document
relinguishing to you all claims on your property present
and future. Be prepared to fire a warning shot or three
into his torso if neccessary. Start a neighborhood watch
with the help of George Zimmerman minus his gfriend.

Not to worried about this really.

As soon as anyone entered our house the alarm would start to blare. If they were still stupid enough to hang around it would just be a couple of minutes before the racket will wake up my neighbor who works the night shift as a policeman in the nearest town.

He’s grumpy too when woken from his beauty sleep ; )
