How To Skip Out On Obamacare Without Being Fined

I will be submitting a new W-4 form to my employer. At the end of next year I will not be owed a tax refund from the federal government. As a patriotic act of disobedience, I am proudly refusing to purchase any health insurance. This would mean that I will be subject to a fine of 1% of my total income (2% the following year, 2.5% thereafter). The awesome thing about that is unless you are due a tax refund, the government will never see a dime of that money.

My choice to not buy health insurance is a choice many people are going to make, either to protest, or once the ObamaCare website is properly up and running and they get a glimpse at the increased cost of the monthly premiums under the Affordable Care Act. During his radio show recently, Rush Limbaugh went into detail about all of this:

Anyway, [my accountant] said to me that, according to the law, the only way that the government can collect the fine or penalty for you not buying insurance is if you are owed a tax refund. If you do not owe a tax refund, they cannot go into your bank account or anywhere else and get that money. Now, the sad thing is that most people file their taxes to get a refund ’cause they think they’re screwing the government, and they’re not. …

Therefore, the only way that they can collect the penalty or the fine is by taking money from your refund. If you are not owed a refund, they cannot get money from you. They can’t issue a lien. They can’t garnish your wages. They can’t use any of the normal procedures available to them if you owe them money, even though the Supreme Court has said it’s a tax. So for those of us — I mean, folks, I’m in fat city. I’m in fat city because I always structure to where I owe money. Well, not entirely. There have been years. But if you structure your taxes so that you do not get a refund, you do not have to buy insurance and you do not have to pay a fine ’cause they can’t collect it from you if you don’t have a refund due.

And that is just another nail in the coffin of Obamacare imploding on itself.

Limbaugh also highlights that in order for ObamaCare to be successful, the program must coerce a few million young, healthy suckers into paying for something they don’t really need. All I need is a catastrophic plan in event the unimaginable happens. Unfortunately, Obama has banned affordable catastrophic plans and is utilizing the mandate as a way to force us into paying for services that we don’t all need like maternity, vision, dental, mental health, and drug and alcohol treatment.

As many as 20 million people could lose their current health insurance coverage because the coverage they are currently happy with has been outlawed under ObamaCare. These ObamaCare victims are certainly going to face higher premiums which they might not be able to buy, or just don’t believe are worth the potential of a 50% to 150% premium increase with a higher deductible.

Remember that you don’t have to pay a fine if you legally ensure that at the end of the tax year you are not owed a refund from the federal government.

That is my question.

If everyone does this the Government is going to come up short a whole lot of money that they spent before it was even due to be theirs.

My next question is how long will they overlook this loophole and find another way to screw those who don’t pay.

They cannot!!!

There is no collection provision in this “tax/law” (whatever you want to call this) that allows for anything, or any mechanism, other than your Federal income tax filing, to be garnished, if it is discovered you are not playing ball...

Find the provision for collection outside of that mechanism in that law, no one I know has found it, and a lot of people have actually looked through it...

It would require Congressional approval for it to happen...It could happen, but I believe it will not happen in time to help this re-distribution plan work...

So if you want, you go right ahead and play ball...

Some of us, hopefully a lot of us will not...And have already made plans to that effect...

After reading all the latest articles in the press/media this weekend, I think the GOP should rally the troops in the House this next week and pass the repeal of Obamacare one more time while there is a compelling case to be made, based on the fraudulent sales job by the president, and the 52 million people who will have their policies cancelled in violation of what they were promised. ACT NOW while the iron is hot. Do the right thing and repeal a law that was passed on the basis of fraud on a scale never before seen in this country. FRAUD is the word. FRAUD. Even NBC can follow that complex story line.

They’ll just apply the fine to whatever is owed, and say you underpaid the actual tax. So you will still get hit for tax.

Our greedy government will not let this stand.

Sometime in the future someone in the senate or congress will point out how much in fines is unpaid and there will be a push for legislation to collect the arrears PLUS INTEREST via wage garnishment, property liens, confiscation of savings, etc.

Did you forget that the IRS is the enforcement arm, if they want money, they will get it from your bank, garnish your wages or pull it from your investments.

Go ahead and take legal advice from a guy on the radio who thought he could get away with doctor shopping. While you’re at it, go ahead and don’t pay a tax that the Infernal Revenue Service say you owe them. Keep in mind, in tax court you are guilty until such time that you can prove your innocence. Be sure to tell the judge that his opinion of the the law doesn’t matter as much as some clown with a radio show. I swear, you guys don’t know who and what you are playing against. But you will.

Proudly refusing to buy health insurance is great, until you get very sick or injured, but if it works out for you..... Are you opting out of your employer health insurance too?

No there isn't.

Rush talked about this extensively several weeks ago on one of his shows and as it turns out he was absolutely correct.

The IRS CANNOT fine, levy, issue lein's, etc.. against ANYONE who does NOT have health care insurance and is NOT due a refund.

The only thing the IRS can do is seize a tax refund if you refuse to pay for insurance.

That's it.

So the entire "trick" to breaking the back of Obamacare comes down to this:

1. Don't take health care insurnace. Don't pay for it, don't sign up for it, nothing. The Government HAS to cover you under Obama care even if you don't pay for it.

2. Adjust your withholding and take the maximum number of deductions so that at the end of the year, you don't get a refund. Rather, you PAY. Ideally, you should set your withholding so that you OWE as little as possible, but do not get a refund.

3. Sit back and watch the fun! The fun will be seeing Obamacare crumble under its own weight very quickly.

Yes, it IS patriotic to do this. It is the highest form of civil disobedience I can think of.

BTW: For 28 years I've "owed" at the end of the year to the IRS. I *NEVER* want to give them an interest free loan. The fact is, the US Government COUNTS on each and every one of us OVER-PAYING during the year. STOP DOING THAT!

Not only should we be breaking the back of Obamacare, the reality is by adjusting your withholding to PAY at the end of the year, you're also STARVING THE BEAST! DO NOT let the filthy, corrupt bastards in DC have "free use" of your money. Period.

This article SOUNDS really good, but yeah, we’re talking about the U.S. FEDERAL government and IRS here...

I tend to believe they will be including a line in our tax return forms regarding this. The ‘fine’, which is a ‘TAX’ after all, will be computed in what we ‘owe’ the government.

They would never EVER let us off so easy as to simply not get a refund in order to get out of it.

The government owns the field, the refs and the ball, they will do whatever they want.

in tax court you are guilty until such time that you can prove your innocence.

Actually, in Tax Court you don't have to pay the tax in order to dispute the tax. Whereas in other courts you have to pay the tax and sue for a refund. From Wikipedia:

"the United States Tax Court does not have exclusive jurisdiction over tax cases. In addition to the Tax Court, federal tax matters can be heard and decided in three other categories of courts: U.S. District Courts, the Court of Federal Claims, and the Bankruptcy Court.[29] In the first two instances, the taxpayer bringing the claim generally must have first paid the deficiency determined by the IRS."

"Genesis of a Tax Court dispute: After issuance of a series of preliminary written notices and a lack of agreement between the taxpayer and the IRS, the IRS formally "determines" the amount of the "deficiency" and issues a formal notice called a "statutory notice of deficiency," or "ninety day letter".[41] In this context, the term "deficiency" is a legal term of art, and is not necessarily equal to the amount of unpaid tax (although it usually is). The deficiency is generally the excess of the amount the IRS contends is the correct tax over the amount the taxpayer showed on the return—in both cases, without regard to how much has actually been paid.[42]"

How do you but only catastrophic coverage? I thought Obamacare outlawed these plans. Are there any foreign companies selling catastrophic coverage to Americans?
