October was not a good month for Justice Marc Nadon, the newest appointee to the Supreme Court of Canada. He never did take his seat on the court. But November, if anything, has started off on a worse note.
He was told to stay away from his office at the Supreme Court building on Ottawas Wellington Street, not to go to the court building and not to talk to any of his prospective new colleagues on the court. And the Supreme Court has very publicly posted those directions to Justice Nadon on its website.
Justice Nadon was appointed from the Federal Court of Appeal, and it is unclear whether any of the three spots reserved for Quebec judges can be filled from that court. The Canadian government referred the matter to Justice Nadons eight fellow judges, asking them to rule on the legality of his appointment.
The Supreme Courts deputy registrar, Mary McFadyen, wrote the federal and provincial governments on November 1 to set forth steps taken to ensure its members are strictly impartial for the Nadon reference case. (A reference case is one in which the Canadian government asks the Supreme Court for an advisory opinion on a major legal issue.)
Ms. McFadyen's letter outlines the measures taken to ensure that the judges will not have any conflict of interest.
As questions concerning the legality of Justice Nadons appointment are pending before the Court, it has adopted the following measures to ensure that justice is both done and is seen to be done in an independent and impartial manner: 1. Justice Nadon will not have contact with the members of the Court. 2. Justice Nadon will continue not to participate in the work of the Court. 3. Justice Nadon will not occupy his office or attend at the Court.

I’m no Canadian, but in an argument between Harper and Quebec I’d vote twice for Harper. Sounds like Canada needs this judge and its liberals know it.
Wish there was a do over on John Roberts.
I don’t know about the rest of you, but I’d be a little hesitant about some judge who talks to benches.

The challenge is regarding whether Nadon is “from Quebec” for the purpose of that law. He was born in Quebec, obtained his law degree in Quebec (from the Université de Sherbrooke), and was a member of the Barreau du Québec for 19 years, but he primarily practised law in England prior to his appointment to the Federal Court of Canada and then to the Federal Court of Appeal and he never served on a Quebec court.

In my opinion Roberts is the worst Chief Justice since Roger B. Taney left Dred Scott a slave.
I’d go with Earl Warren.
Say what you will about Earl Warren, but he at least believed there were limits to government power. Not so Roberts. Apparently there is nothing that the federal government can’t require of citizens. He’s reinstated slavery after 150 years.
Warren, without question.
