There is, in fact, a federal law that makes it illegal to confiscate the 4473s.....they would have to disregard that law.

...and we all know that Obama would never disregard a law...

...except the ones he does not like, of course.

The ATF actually went into several AZ shops and told them they wanted copies of the 4473s Some stupid employees actually complied, but the owners that knew the law told them to go eff off.

The point is that until this government goes completely tyrant, they cannot willy-nilly demand what they don’t have a right to. After that point, then it is all bets off and the ATF had better be well armed when they try it.

Sure they can. They can demand anything they want. Your anecdote shows that.

It was good that the case you mentioned the ATF's demand was rebuked, but the agents involved were still guilty of disregarding the law. Did the shop owner press charges against anyone? Were any ATF agents reprimanded or fired?

What would have been the outcome if the shop owner had not been there to stop his employees from turning over the forms? In that case, the ATF would have successfully disregarded the law - and it is doubtful that any charges would have been filed or any agent(s) reprimanded or fired.

And, for the record, the federal government does not have Rights, it has Powers.

They, ATF, didn't demand anything, they asked to have copies. And, in their interpretation, asking isn't demanding and not against the law. Willing and stupid participation of personnel unaware of their rights was what caused a compromise. Until they actually 'demand' at the point of a gun, they have no actual power - only perceived power. And that it is where it is up to the citizen to assert his/her rights.

As far as I am concerned when a federal agent “asks” for something he is, in effect, demanding it.

Not if you know your rights. Asking a question by a Federal Officer and then being proven the answer is a lie is an offense that is punishable.

Asserting your rights is not. You’re too willing to assume Federal Agents always are within “their” rights. They are not.

Canada's newest criminals

The original link to the FR post, no longer has this article, and the original link to Globe & Mail article has expired.

The federal government received a last-minute rush of licence applications from gun owners, but it appears that hundreds of thousands of people let the Jan. 1 deadline pass and now own their guns illegally.

...

They said the rush brought in thousands of applications a day since they counted 1.8 million licensees in late December. But it appeared likely the final total would remain hundreds of thousands short of the 2.2 million gun owners estimated by the Justice Department.

...

Under the federal Firearms Act, also known by its bill number, C-68, all gun owners had to obtain a licence before Jan. 1. By 2003, gun owners will be required to register each gun they own.

The law has been attacked by firearms advocates, many of whom fear that the registry will eventually be used to confiscate guns.

Obama is a crook. He took the offer they made. Look at everything he has ever been involved with, and ask yourself if the Frackwad in Chief profited.

You did, however, ascribe an implied power that any question a “federal” agent asks is an order....how in your mind is that not a right?

The long gun registry was repealed by the conservative government but not because of its failure to work. It did work sufficiently enough to trouble its opponents and such people who consider long guns to be tools, such as farmers and Aboriginals.

The Conservative party had campaigned against the gun registry before it took power. It was unable to carry out its intent during a series of parliaments in which it was a minority government, It finally achieved majority government status which gave it the votes to repeal the long gun registry.

Some Provinces are still resisting and attempting to get the information which the repeal statute had required to be destroyed so as to give them a start on maintaining their own registries.

BTW speaking of Aboriginals, my favourite tale of the debate was of an aboriginal Member of Parliament whose response to the "safe storage" requirement in the original Liberal legislation was "my mother lives in a tent".
