US Supreme Court agrees to hear greenhouse gas cases

The US Supreme Court Tuesday took on six cases related to federal regulation of greenhouse gasses, raising expectations for a much-awaited ruling in the debate over climate change legislation.

The court announced it was combining the six suits from plaintiffs in the chemical industry, the Chamber of Commerce, and the state of Texas, each protesting carbon emissions regulations put in place by the Environmental Protection Agency.

All six cases address just one question: Whether the agency "permissibly determined that its regulation of greenhouse gas emissions from new motor vehicles triggered permitting requirements under the Clean Air Act," the court said in announcing it would take the appeal.

Hidden in this story is a statement that the Supremes are also going to consider whether or not a gun owner can sell a firearm to another individual.

And next they'll consider whether a gun owner can give away a firearm as a gift and then accept a "donation".

Big fat good the Supreme Court will do to help commonsense. They already gave the damned EPA permission to regulate CO2.

What a bunch of idiots. Scalia wrote the dissenting opinon, but it is too late now I think. Could they overturn it?

Sure. Will they?

No.

From the write-up, it sounds like the court could avoid any discussion of global warming (or even climate change) validity and skip right to whether the EPA have the authority to regulate emissions.

Not getting a warm fuzzy on this one.

Someone will just say the word ‘tax’ and John Roberts will react like Pavlov’s Dog.

This suit is not challenging the 2007 SCOTUS decision which gave EPA authority to regulate.

The plaintiffs say that EPA's endangerment findings were faulty and that EPA doesn't have the legal authority to "tailor the regulation".

The original suit was in 2010. The DC Court of Appeals ruled for EPA in June 2012. The plaintiffs appealed to SCOTUS last May.

Oh come on man, the percentage of CO2 in the earths atmosphere is zero point zero. If we wait any longer it could get as high as zero point zero so thank God Al Gore has us cutting back on fossil fuels otherwise that CO2 level could get as high as zero point zero.

I know. I should have focused more on the content of the article rather than just griping about the SJC in general.

I have completely lost faith in the ability of the Supreme Court to ajudicate anything with even a smidgen of commonsense.

Roberts broke my mental and emotional back when he ruled on Obamacare.

The only ones who I feel I can count on are Scalia and Thomas, and possibly Alito (but not really). And they won’t be around forever.

We are certain to get another Sotomayor or Kagan.

This just plain sucks.

The original 2007 decision in which SCOTUS ruled that CO2 was a pollutant was 5-4, Kennedy ruling with the 4 dems.

And a great, big "THANK YOU" to Perdogg for helping with the SCOTUS pings this summer when I was swamped with other things. We appreciate you, Perdogg.
