San Diego Judge Gary Kreep, a conservative legal activist who led a failed fight to challenge President Obamas citizenship, has been exiled to traffic court after several Superior Court rulings favoring defendants constitutional rights.
Kreep, 63, was reassigned on Sept. 9 from the downtown San Diego courthouse to a Kearny Mesa facility that handles traffic offenses and small claims.
The move came after prosecutors from the City Attorneys Office began to boycott his courtroom over his legal approach.
For instance, Kreep often declined to take away a defendants 4th Amendment rights against search and seizure something prosecutors can legally request at various points during the criminal process.
No official reason was given for Kreeps reassignment. Presiding Judge Robert Trentacosta said through a spokeswoman that the court doesnt comment on judicial assignments.

In all fairness, I imagine his greatest affront was “rocking the boat”. Courts, judges and lawyers are often lazy places, where the emphasis is on performing their roles in Kabuki theater, instead of honestly carrying out justice, which is a lot more work.
This can easily become stagnant and dishonest. While there are many examples, some of the worst are threatening defendants with draconian punishments, or light punishments if they accept plea deals.
Hand in glove with that is that they must admit guilt, even if they are obviously innocent, both because it precludes appeals, but even more so, to assuage the guilt of the judge and prosecutor, who at least suspect that they are railroading an innocent person.
What is of particular interest to me in this is that public defenders are nearly always liberals who try to keep criminals out of jail while prosecuting attorneys are often conservatives whose job it is to lock criminals up.
Judge Kreep (who I voted for) has the support of the public defenders and is being criticized and demoted at the behest of the prosecutors.
