Student Faces Expulsion For Playing With Toy Gun In His Own Yard

A suspended seventh-grade student in Virginia Beach, Va., could be expelled for the rest of the school year for shooting an airsoft gun with a friend in his yard as they waited for the bus to come.

Khalid Caraballo, 12, and his friend, Aidan, were suspended for “possession, handling and use of a firearm” because they “shot two other friends who were with them while playing” with the airsoft guns, WAVY-TV reported.

…Caraballo answered “no, sir,” when asked if he took the toy gun to the bus stop or to school.

“We were in our yard. This had nothing to do with school,” the student said.

Caraballo’s mother, Angel, said being punished for “possession, handling and use of a firearm” was “pretty harsh” for a toy that she bought for $25.

The only solution is a lawsuit and a large financial penalty against the school district.

There are actually much better solutions personally involving the fascists who are persecuting this child but to suggest them may be illegal.

I base it purely on my surroundings. I’m in the blue part of Ohio, and I can tell you, it’s already gone.

Don’t think they should be expelled, but want to point out that airsoft are more like BB guns.

My son and huband do not shoot them in our neighborhood. They play in organizwec games and the always wear protective eye gear.

They are not a nerf or water gun!!

In the other thread, the actual letter from the school states that the reason for the suspension was because the kid was assaulting other kids at the bus stop with it, NOT because of simple possession. The kid was an idiot and thug-in-training.

I agree that they were firing projectiles at kids off their property, so their defense in that regard doesn't hold up. But when did an airsoft gun become a firearm?

Another lawsuit needs to be against the idiot 911 caller who is also the mother of one of the kids playing with the oh so scary guns. Unbelievable. These ninnies make me "uncomfortable" to the extreme.

The caller also knew the gun wasn't real and said so, "This is not a real one, but it makes people uncomfortable. I know that it makes me (uncomfortable), as a mom, to see a boy pointing a gun," she told the 911 dispatcher... Ironically, that 911 caller's son was playing with Khalid and Aidan in the Caraballo front yard

and the first step in the lawsuit is to fill a restraining order against the caller. Next step is sueing the VA Beach Public Schools because by law, airsoft guns are not firearms in Virginia. Angry email going out to State Rep tonight because this airsoft is a firearm crap has been going on for a while. It was supposedly fixed a few sessions ago, but maybe VA Beach has not gotten the message.

In many city anything that launches any projectile is illegal,because one evening thirty years ago the majority on city council passed an ordinance that was never challenged.Nearly all cities make discharge of a firearm within city limits a crime. The tricky ones added BB guns,dart guns,bows and arrows, and everything else to the definition. And for that matter in the 1950s some people target practiced with .22CB in large basements or backyards.

Firearms possesion and knowledge by the general populace is a danger to tyrants;that is why the push to eliminate guns.

brownsfan - My kids BOTH shoot “Expert”, rifle AND pistol. 21 and 18. Been shooting since they were tiny. So does my wife.

I’ve taken their friends to the range. I’ve taken their friends’ PARENTS to the range. I’ve taken my wife’s friends to the range. I’ve taken kids from the youth baseball team I coached to the range for “Kids At The Range Day”.

You CAN make a difference. Just make it a point to DO it. I became a certified instructor just so I COULD make a difference.

As Cyber Liberty pointed out, gun and ammo sales are indeed through the roof.

Push back, and push back HARD. We’ve won right to carry in almost every state.

Kids today know MORE about guns and types of guns from Call Of Duty/Modern Warfare, Black Ops, and other video games than we EVER knew growing up. That’s fertile ground. The interest is already there; you just have to teach them properly.

Take EVERY opportunity to educate them on their rights, and the fact that ANYONE trying to take that right away from them is the enemy.

Fight fire with fire. This is winnable. It’s OURS to lose.

Every generation gets it’s chance to fight for its liberty; sometimes, it’s not so clear that it’s happening. And in some cases, that moment passes by without ANY fight happening (which is why we are where are right now).

But this - THIS is as clear and bright a line as you’ll ever see, right now. And how you decide to jump in the fight is what matters - what you, and me, and every other Patriot across the country does to counter the libtard psychopaths is what matters.

All of us older gunnies - We ARE the resistance, brother. And we are teaching younger folks who the enemy is.

They shoot 6mm PLASTIC BBs, and while yes it COULD damage an eye from a careless shot, when they hit the body, it only stings a little bit.

Was the kid wrong for shooting other kids with it? Yeah, his father or mother should have walked outside and smacked him upside the head for doing that - and THAT should have been the end of it.

Boys will ALWAYS be boys and have a healthy curiosity for ANYTHING that goes bang, boom, blam... and we need to teach them accordingly and safely.

And Airsoft guns are great for teaching fundamentals - trigger squeeze, sight picture, proper safety. My kids learned on .22s at the range, and Airsoft pistols in the den and yard.

I agree that this is ridiculous. It's a means of holding a serious criminal charge over the kid's head, as a way to force him to plea-bargain and settle.

Virginia has the Dillon Rule where all Gun Laws must come from the State Legislature. So most of these regulation are illegal when it comes to firearms other than the discharge within city limits thing. I cannot remember if the VCDL had the rule apply to airsoft or not, but it has come up a few times to take away the local rights to regulate non-firearms. I will try to look it up.

Found it, it went into effect July 1, 2011

SB 757: This bill allows an individual to shoot an air rifle (BB, Airsoft or Paintball guns) on private property with permission of the property owner, as long as they take reasonable care to ensure the projectile does not cross property boundaries. Any local ordinances that do not allow this exception will be pre-empted. A number of localities (i.e. Fairfax and Blacksburg) have already begun amending their local ordinances to bring them into compliance with the new law.

He was reportedly deliberately shooting kids waiting at the bus stop, so that violates "does not cross property boundaries" clause.
