And I say yes to the word's continued use among those historically victimized by it. It's for the users to work out when and where use is acceptable, not the courts...
Q: Does it matter how you pronounce or spell the term?
A: Yes. It matters significantly that the groups who have recast "n-----" as "nigga" (or some other version) are respected on the grounds of their re-appropriation of the word. The respelling embodies the reality of changing historical moments and identities. Words and people are not stuck in the mud of historical stasis, but tap into history to make their own history.

Are you sure? I know it was used freely among the Brits. One of Ian Fleming’s Bond stories had a chapter entitled “Nigger Heaven.”
The chapter was retitled in the American edition.

The Brits used it for any dark-skinned people, like darker Indians, not necessarily just Africans.

Back in the ‘80s my best friend and I were in my office during lunch hour, just shooting the breeze and discussing our weight issues. We were arguing whose body was worse, each saying, “I’m wider than you.” “No, I’M wider than YOU.” “No! I’m wider!” Back and forth, kidding around.
In walks Celeste, our resident black victim who was always looking for race-based trouble. “Why you talkun’ ‘bout who be whiter?!” She was incensed to hear the word “white” (wide). Pat and I went into fits of laughter. I guess we’re lucky we weren’t slapped with a harassment suit or something.

In my neighborhood the term was “moolies”, but then again we had weird ethnic slurs for all groups, including ourselves
