Texas Won’t Prosecute Father Who Beat His 5-Year-Old Daughter’s Molester To Death

In rural Lavaca County, Texas, a grand jury refused to indict a father who, when he caught a farm hand attempting to rape his five-year-old daughter, beat the farm hand, accidentally killing him. The incident took place on June 9, near Shiner, Texas. Someone alerted the little girl’s father that Jesus Flores, a farmhand, was seen carrying the little girl to a secluded area.

The father took off in the direction that the farmhand was seen traveling. As he drew closer, he could hear his little girl screaming. When he reached the two, both the farmhand and the five-year-old had their underwear off. The father promptly beat Flores into unconsciousness.

Members of the Lavaca County prosecutor's office announce that an unnamed man will not be prosecuted for killing man who was attempting to rape his daughter.

Only after he was certain that Flores was no longer a threat either to himself or to the little girl did the father place an anguished 911 call seeking help for Flores. Practically weeping, he said to the 911 reporter “I need an ambulance. This guy was raping my daughter, and I beat him up, and I don’t know what to do. *** Come on! This guy is going to die on me. I don’t know what to do.”

Although the county classified Flores’ death as a homicide, the Lavaca grand jury declined to indict him, saying that it was justified homicide. In Texas, deadly force is justified in order to prevent an aggravated sexual assault.

The father’s community was very supportive of him. In Texas, justice is swift and sure, and a child rapist caught in the act by an enraged father doesn’t have many rights.

"That should be the law in every state."

It may very well be. This isn't the aberration it might seem. Self defense laws don't just apply to using guns, and they allow you to defend someone else, especially your child.

It matters that he caught the guy in the act and the force was used to stop the assault. It’s not like he hunted the guy down and killed him in revenge. That probably wouldn’t have flown, even in Texas.

And think of all the money the county saved on a trial- that would certainly have ended in an aquittal. They’d never find a jury to convict the father of any wrongdoing in this matter.

Born and raised in New York City. Spent almost all of my adult life in New England. Spent a couple of years in Texas at Fort Hood. So why do I miss Texas so damn much?

Thanks! And likewise, here. Let’s hope all the unconstitutional nonsense doesn’t get that far, eh? It’s interesting to be living through such a pivotal time in our nation’s history, but i could definitely live without it.

Took me a second to realize what you were referring to. :)
I’ve been using “Barak” as a screen name for about twenty years- it’s a reference to a character in a series of novels who sometimes turns into a bear (I’m a large, bearish man, according to some).

Back to the subject at hand- I had a vision last of night of what would happen the first day of trial if this man was charged-

Prosecutor (opening statement)- This man caught someone attempting to molest his 5 year old daughter-

Jury- (in unison) NOT GUILTY!
