As was widely reported this week, the White House has delayed implementation of out-of-pocket caps in Obamacare insurance policies until 2015.

The SCOTUS decision justified the constitutionality of Obamacare by rendering the cost of its policies to be taxes. By delaying out-of-pocket caps, the cost (tax) to the consumer will increase significantly for many policyholders. This amounts to a unilateral, White-House mandated tax increase which did not originate in the House of Representatives, let alone pass with a vote.
Can a FR lawyer explain to this humble engineer why this is legal?

Today Rush Limbaugh, talking the potential Hillary will run in 2016 did make a comment something to the effect if Obama decides to give up the office in 2016.
Given the way events are unfolding, and at an extremely rapid pace, I’d say the odds are better than 50/50 if Obama announced he was suspending the election and would be submitting a new Constitution for ratification by Congress (not the states), the Congress would ratify it.
Not for the first time, either.
And the House, the only entity with the "standing" and power to prevent it, sit with their thumbs up their Obamas!
I have asked this regularly for the last FIVE years...
When the government acts illegally, and elected representatives fail to prevent it, or actually participate in the criminality, what options are left for the ordinary citizen?

Unless something has changed (in Obamacare's 20,000 pages?) if memory serves me right, any amendment must still be ratified by 2/3 of all the states.

The states must ratify amendments to the Constitution, you are correct. But the proportion is 3/4, not 2/3.
I KNEW from from the beginning that if somehow Obamacare was defeated, overturned, or delayed, all that tax money needed for would stay with (or continue to flow to) the government.
Republicans can’t say ‘no’ to tax increases, either. And the better the disguise, the more they like it!
