The senator steals a march on potential 2016 rivals.

The early dynamics of the 2016 Republican presidential-primary contest were jolted on the morning of Friday, July 19, in a ballroom on the third floor of the Marriott hotel in downtown Des Moines. It was there, in front of coffee-sipping pastors, that Senator Ted Cruz of Texas wowed the kingmakers of the Iowa caucuses for the first time. Without notes and ignoring the podium, he roamed the carpeted dais for nearly an hour, quoting Scripture and musing about the Democrats and their occasional affinity for Satan. The reception was rapturous. Many ministers eagerly asked Cruz’s advisers where they could sign up for a campaign that doesn’t exist, while others encircled Cruz and laid their hands on him to pray.

Veteran operative Chuck Laudner, who managed former Pennsylvania senator Rick Santorum’s victorious Iowa campaign last year, was in the room and remembers the scene vividly — and he knew immediately that all the post-2012 conventional wisdom about the 2016 field was, with one speech, obsolete. To him and others who make their living as consultants within the Republican universe, the visceral response by Iowa preachers confirmed Cruz’s ascent as a new, potentially disruptive force in the GOP’s presidential-primary calculus. Instead of the looming battle for tea-party support in Iowa and South Carolina featuring a group of middleweight contenders — vanilla governors, House members, and little-known senators — it appeared that a Cruz phenomenon could overwhelm them all. He channels the anger and frustration that conservatives have not only with President Obama, but also with the Republican establishment. His ability to seize that undercurrent and connect with those voters has elevated him.

The Constitution, Art. II, says in pertinant part: “No Person except a natural born Citizen, or a Citizen of the United States, at the time of the adoption of this Constitution, shall be eligible to the Office of President;”

Since everyone who was a citizen at the time of adoption is dead and likely to remain that way, we can remove the grandfather clause wording. We are left with “No Person except a natural born Citizen [...] shall be eligible to the Office of President;”

Why does the Constitution speak of “citizens” and separately of “natural born citizens”? It is a matter of allegiance.

A person can be a “citizen” if they were citizens or subjects in some other country first but have come here and met the naturalization requirements. Also, if one is the offspring of a citizen and a non-citizen, then one is a US citizen. However, in both these cases it can be argued that the person might choose allegiance to their former country or to the country of the foreign-born parent or at least the allegiance might be considered divided. It is this divided or alienated allegiance that the Constitutional provision is designed to prohibit.

If, however, both of one’s parents are themselves US citizens, then one is a “citizen” as well as a “natural born citizen”. The “natural born citizen” is one who at birth has no natural allegiance to any other country and the Framers felt could be trusted to be loyal to the US and not act as a foreign agent. (*)

Note that native born is not the same as natural born. Native born simply refers to the place of one’s birth, i.e., one’s nativity. The term does not speak to the legal circumstances of a birth, merely to its location.

(*)[footnote: Also, in their time, the rules of royal succession held sway throught much of the world and the Founders wished to forestall any potential claims by the crowned heads of Europe or their scions to sovereignty in the US.]

Cruz has an IQ of 168 and a law degree from harvard. He would not run if he is not eligible and he will be able to explain why he is eligible if he runs. Let they naysayers wail and knash their teeth.

I was and am a huge supporter of Senator Cruz. I would really like one day to see him on the Supreme Court. I doubt his Constitutional eligibility for the Presidency. If he's running he owes us - and I look forward to hearing - his explanation of what he thinks a "natural born citizen" is and how he qualifies as one.

I feel a little badly for those who are not current with Cruz postings as they are most likely innocently ignorant of this debunked issue.

But for those who already know and use this as a means to push "Their Rhino" I have little patience. Your homepage is inspiring.

Well, that someone sure isn’t the Pillsbury Dough Boy. No way he could carry the Red L. Heck he might not even carry New Jersey and he sure doesn’t have the coat tails to bring along any of the other blue NE states. So, as we say here in Texas, Christie is all hat and no cattle....

His explanation - yours, mine - even the explanation clearly outlined in the Constitution is irrelevant. If we were to simply abide by the Constitution - then Cruz is not eligible. But then - neither was Obama.

So. How do we support Cruz for president? Simple. We look at hundreds of lower courts who have ruled on what a NBC is. We look at the Supreme Court that has not overturned these rulings. We look at all 50 states and see no credible challenge. We look at the Congress which raises no objections. We look at the leaders of all political parties who raised no objections. We leven look at conservative talking heads like Rush, Levin and others who remain silent. All this and more.

And we face reality. Look. I’m the biggest birther there is. But the fact is - this is settled law. Ted Cruz is a Natural Born Citizen.

I don't agree with PITN at all. Cruz IS eligible. If the birthers ever actually WERE right about their singular interpretation of "natural born citizen", the precedent of the past two elections has destroyed their argument.

My 2 cents......

The progressive wing of the GOP is scared to death off Ted Cruz. He is going to give them a good stropping if he ever gets on a debate stage. Ted Cruz is for real folks.....I’m am still honored to have been given the privilege of voting for him!!!!
