The State’s Case Against the State
American Spectator ^ | 7/5/2013 | Daniel J. Flynn

Who in his right mind would ever hire George Zimmerman’s prosecutors?

It started by dropping an F-bomb. The prosecution’s case went downhill from there.

The state’s ineptness permeates the entire trial of George Zimmerman, from the over-the-top second-degree-murder charge to the lack of a single African American on the jury.

The prosecution playing video of Zimmerman providing his version of events without having to endure cross-examination demonstrates the level of incompetence. Instead of the cold, emotionless, blank stares of a killer, the jurors saw a likeable, unthreatening, mild-mannered, pudgy man. After demonizing Zimmerman outside of the courtroom, the prosecution strangely humanized him inside of it.

The mumbling and semi-literate Rachel Jeantel proved a stenographer’s worst nightmare. The prosecutors probably now regard her as their nightmare, too.

By testifying that Trayvon Martin referred to Zimmerman as a “nigga” and a “creepy-ass cracker,” Jeantel flipped the script on the racial motivations surrounding the tragedy. She appeared more of a partisan than a witness when she repeatedly told her pausing interrogator, “You can go.” When she admitted that by rushing through a deposition she had compromised its accuracy, Jeantel eroded whatever credibility her behavior hadn’t already destroyed. Like the deposition, and Martin’s wake and funeral that she skipped, Jeantel clearly found testifying a terrible bother. She tapped her fingernails, rolled her eyes, sighed, and when faced with the prospect of appearing on the stand for a second day, declared, “I’m leaving today.” The prosecution should have retroactively granted her wish.

This article correctly points to the prosecutorial ineptness, but the problem all Americans with a functioning brain should be concerned rests in the attempted prosecution of a non-crime.

The police determined that Zimmerman had acted in self defense and prosecutors agreed--until the POS in the White Hut shoved his African-African nose into the matter and then the threat of mob violence forced these moral cowards to prosecute a charge of 2nd degree murder.

Perhaps the six jurors will add to this miscarriage and be so fearful that they will convict this unfortunate man , but I think a hung jury is the most likely outcome.

At any rate if George Zimmerman is properly exonerated it is a cinch he'll never vote for a Democrat again. He supported the POS that stated he could be Trayvon's father.

We can only pray for an acquittal, because this trial couldn't have happened at a better time. With statism on the ropes due to the central socialist government imploding on all fronts it points up the inherent evil of an all encompassing federal and state monster when they attempt to act in concert.

I predict a conviction on manslaughter. I hope not guilty on both but not too hopeful.

Why?

The self-defense claim for both 2nd degree murder and manslaughter are exactly the same.

I’m praying the jury will do what’s right for George Zimmerman and his family. This never should have been brought to trial to begin with. That judge and the prosecutors look like fools, but worse, their actions seem to be pure evil!

If it’s a hung jury, I think the state will try him again and again

There are only two ways they get any kind of guilty verdict:

1. Every single one of the jurors fears for their very lives and have no character.
2. The entire jury is bought and paid for.

I doubt either is true. I think the best that the state can hope for is that number one applies to at least one juror and we end up with a hung jury. People talk a lot about number two but it is, in reality, highly unlikely.

Frankly, if I was on that jury and I found him guilty, I’d worry more about the Timothy McVeighs they created than the rioting caused by a not guilty verdict.

You can’t help but wonder what the NSA has on the jurors.

Manslaughter — overturned on appeal.

An all-female jury will reach “consensus,” probably with a wrong decision, so that they can “stand together.”

Who in his right mind would ever hire George Zimmerman’s prosecutors?

A low budget comedy show aimed at the 75 IQ points market?

There is zero ineptness with the lack of an African American on the jury. None is required.
Who thought up this drivel?

I suspect that the liberals are hoping for an acquittal to further inflame racial conflicts, and to allow Holder to file a civil rights violation case against Zimmerman and the state of Florida

The prosecution is trying to make the case to the jury that is outside the courtroom.

This is off the Zimmerman issue, the author wrote:

"The client list of Don West and Mark O’Mara dries up if they perform the way their courtroom adversaries do. The prosecutors won’t be out of a job because of this fiasco. Because consequences rarely attach to actions in government, the state incentivizes recklessness."

This touches on a pet peeve of mine for decades. One, our legal system is fundamentally based on a misconception, ie the criminal cases are "The People" vs. George Zimmerman. Actually, it's the estate of Trayvon Martin vs George Zimmerman. It's any criminal action vs. the actual victim of that criminal action.

Again, off topic, that's why some crimes (prostitution, buying illegal drugs) are called "victimless", because there is no complaining victim. The "crime" is consensual.

So, if we would change the criminal law to reflect the reality of a criminal committing a crime against specific people, we could then privatize the prosecution. So, the Martin Family has Crump and Gang has lawyers, why can't they determine and hire the lawyers to prosecute their case? Why is this a State monopoly?

There are no consequences for the employees of the State, when they screw up. We should limit the number of State employees and get government out of everything we can.

Again, off topic, why not professionalize the jury system. They are the only ones in the legal system without legal advice. Why not have a new career of professional jurors? Their jobs would be dependent on coming to just verdicts, that would be their incentive. Would anyone hire members of the OJ or Casey Anthony Juries?

Given that my neighbors sicked (sick - ;-) ) the local gov’t on me, when I talked to the local gov’t attorney I always referred to my (hegemonic, (running dog)) neighbors as the “not your clients” since the gov’t attorney claimed that they (the gov’t) didn’t represent the complainants when they really did.

"Again, off topic, why not professionalize the jury system."

My local gov't unit will not let me "serve" anymore. I always ask about jury nullification.

"..we could then privatize the prosecution..."

I believe that in the (distant) past in America, that was common.
