By not rolling down his window the driver was asserting his 5th Amendment right against self incrimination. Assertion of 5th Amendment is not a basis for probable cause. The officer knew that. The officer used K-9 team to create probable cause.

The most troubling aspect is he didn’t even have to ask the K-9 officer to provide probable cause. The K-9 officer knew his roll without being asked. It is an unspoken SOP in that unit that the dog will be used that way. Disgraceful, but SOP all over the country.

Yep, with all the high tech gadgets. We went through in October 2010 on our way back from Oregon. On the way in we were weighed and sounded, photographed and recorded, asked if we were U.S. citizens and sent on our way. So, a short stop but why not secure the border? Why bother us and 99% of the other folks driving through who hadn't been to Mexico?

On the same trip we were going to go and see Hoover Dam but on the way in we saw the checkpoint with all the "officers" rummaging through folks' cars and deciding we weren't going through that, made a hasty u-turn. I am half surprised somebody didn't come after us.

Yep, I'm afraid community policing is gone to the dust bin.

Increasing militarization of law enforcement, tactics used against citizens to intimidate and strike fear.

Overwhelming force...that is the object of policing these day’z. Overwhelming force against anyone who dare stand for their rights.

Trust me, if you do not submit and do it immediately, you will be hurt very badly. May not get shot, but you will get hurt. This can happen for something as minor as a traffic violation.

Try it sometime. Attempt to stand up for your rights. Refuse a vehicle search, refuse to answer prying questions and see the result.

Hey this is an internet forum.
Freerepublic actually used to be a whole lot more fun than it is now. The posters were more colorful and I think of a better quality.

That being said I don’t think that checkpoints are Constitutional, but that is now settled case law. It is instructive to see how the Police subvert the “wiggle” room they have. It is instructive in that clearly giving power to Police, aka checkpoints just leads to more stretching of what is acceptable and legal for them.

My intent in posting this is to educate voters. The case law is settled on checkpoints, the politics is not. Voters influence policy, and they influence local funding decisions.

I was being provocative, and your “spirited” response was much enjoyed ;)

Agreed, blowing .08 does not in any way prove impaired driving, and with such harsh penalties the government ought to be required to prove an act which is in fact unsafe. As an infrequent drinker (and not necessarily because I am), I consider myself impaired at a pretty low level, and I know my limit and act responsibly. Others I know can put away a lot more before I would be worried about them. Point is, everybody doesn’t fit neatly into the same box and impairment can not be simply measured, rather it must be observed.

Apologies due to you from me as I re-read the thread very quickly here, if your mindset is that these checkpoints are fundamentally wrong and an abuse of power, and indeed, a quick persusal is that you didn’t say any such thing. Having a different opinion is fine — what I and IncPen were doing was saying, if the poster is going to have that opinion, that the checkpoints are okay, isn’t a conservative.

My problem was the officers knew the guy was innocent before they started to search the vehicle. They even say so on the tape at that point they are way over the line and have broken the law themselves.

That's way too good.

I've always advocated having a rally of men and woman on a private ranch, hopefully gathering a thousand, two, five thousand...everyone armed to the tee. Sling the rifles, holster the sidearms and invite the press.

Keep it lawful and on the up and up, but the intent is to send a loud and clear message.

I'll never forget the gentleman that attended the Tea Party rally up in D.C. with a sign that read, “We came unarmed this time.”

Enough is enough. I'm damn tired of watching these idiots spend and mismanage this country...it is a NATIONAL SECURITY issue as far as I'm concerned.

Not advocating violence. Violence is a long way off, but the gubbamint should know, ordinary folks are sick and tired of being portrayed as lunatics, terrorist and nutjobs.

We want our country back.

Ugh! Oh no about Hoover Dam, that’s so sad you didn’t get to go! IMO that it’s all a sham to hassle US citizens.

I don’t leave the house much (work at home) and don’t drink a drop ever. But, if I saw these DUI checkpoints, I would turn around. We have the home team advantage in the desert, people can see the checkpoints from a long way off, even in the city.

The issue I have is that the state enjoys the revenue from alcohol sales and permitting so they do not go after the establishment.

With such low levels set for blood alcohol levels, a fella could have two beers with lunch and get pulled over shortly after leaving the establishment and blow a .08 easily.

Why doesn't the state just ban alcohol sales except that which a person can take to the house?

They'd lose millions in revenue. It's all bout the money. If they were really serious about preventing drunk driving...kill the sale at places like pubs and honkey tonks. Stop selling at 9pm rather than 1am or 2am.

All about the $$$

Some carried both rifles and pistols. The old World War II vets rode in cars and held their guns up for all to see.

BTW, before the parade, one of the sheriffs got on the PA system and I’ll paraphrase him: “We know that there are ATF, BTF, DHS, FBI people mixed in among us today. They are welcome to join us law abiding citizens exercising our rights to free speech and bear arms”.

He was letting them know we knew they were there. It was a great day.
