Would You Cross Examine, or Question, Sybrina Fulton ? (Poll and Thoughts)

Driving back from Miami-Dade today, and recognizing the defense had run out the clock on Sybrina Fulton’s opportunity to testify, this question crossed my mind: Should the defense ask her any questions?

I’m absolutely the wrong person to actually answer that question, because quite frankly I have researched too much about her.

But I’m wondering what you think?

Is the risk of seeming callous toward a grieving parent such that asking her deliberate questions should be avoided?

If it were up to me, I would. But again, I’m way too close and too understanding of her manipulations. Almost all of which would never be grasped or understood by a jury. Especially a jury of women and Moms.

The types of questions I would ask would be to open doors to further evidence – The prosecution would never expect the defense would be so bold as to crack those doors with Sybrina on the stand – If you think about the evidence they would frame around her testimony, they themselves would be opening quite a few doors, is it possible to walk through them? I already know the answers to most of these specific questions, but would really like to see Sybrina’s reconciliation:

Who was the primary legal guardian of Trayvon – Yourself, or his father, Tracy ?

You have testified the voice you hear on the recording is Trayvon. When was the first time you heard this recording ?

Where were you at the time you heard this recording ?

What was the purpose behind your request to listen to the 911 call in Mayor Triplett’s office?

Was it your idea to ask Mr. Triplett for the recording?

With that in mind, how were you then, and how are you now certain the voice was Trayvons ?

You state with maternal certainty the voice you are testifying to was Trayvon…… Prior to the shooting of Feb 26th – When was the last time you actually talked to Trayvon ?

You state with maternal certainty the voice you hear was Trayvon….. Prior to the shooting of Feb 26th – When was the last time you physically saw Trayvon ?

When you heard from Tracy on Feb 27th at 11:05am that Trayvon was shot/killed, you never went to Sanford. Why is that?

So, when, approximately, was the first time you left Miami and travelled to Sanford/Orlando? Can you remember the purpose for that visit ? Who did you meet upon arrival ?

Where exactly was Trayvon physically living prior to his departure to Sanford ?

Was Trayvon living with you on the final day he attended Krop High School ?

Did you pick him up from School? How did he return home that day from School ?

Trayvon had a cell phone on his person when he was shot and killed – who was the primary account holder for that phone ?

What was the first name of Trayvon’s closest male friend ? Who did he “hang with” ?

Approximately two weeks after Trayvon was shot, you filed a Trademark application to trademark the phrase: “Justice For Trayvon” – why was that ? Was that your idea ? If not, whose idea was it ?

Just some things for Sybrina Fulton to think about as she contemplates the testimony she will deliver tomorrow.

Of course the prosecution would object, the judge would sustain the objection, but the question would be in the minds of the jurors "Why did the prosecution object to that question ? "

Good questions.

How often did you see Trayvon when he was living with his father and step-mother for fourteen years? Once a week, twice a week? Summers only? Or did he live to far away to make it an easy trip to see him on any sort of regular basis.

Too much potential down side in a rigorous cross exam, imo. Ask her one question: : "Where were you on the night that TM was shot?"

Maybe ask a couple of questions to elicit objections from the pros so that the defense can sear into the jurors that her testimony is irrelevant to the guilt or innocence of George Zimmerman.

Trying to impeach this witness would hurt the defense just about any way you cut it.

Good questions, but the defense can only ask questions on cross about items brought up during during direct, and even these nits are probably smart enough to not give the defense any openings!! However I would love for her to supply “Character Witness” comments, which would then open up Travons true character to examination!!

I don’t think Sybrina Fulton will testify tomorrow, but if she does...

Q: Why didn’t you contact police immediately once you discovered the identity of the young woman who claimed to be on the phone with Trayvon Martin the night he died?

Q: Did you instruct, coerce, or otherwise influence the testimony of this young woman?

Q: Whose decision was it to interview this young woman in the living room of your home in your presence?

I am surprised the prosecution is even putting her on the stand. If she “identifies” the voice as being Trayvon’s, why wouldn’t the defense be able to introduce the expert’s opinion that the voices are unrecognizable?

If I were the prosecution, I’d never put her in a position to destroy what little case I have by trying to get her id the voice. All she has to do is say something that reflects on Trayvon being a good son and the dam will burst for the prosecution. Too much bad...not enough good...to call her.

You’re right however wouldn’t it be interesting if after Sybrina, the state rests its case, and then the first person the defense calls for its case is Sybrina —

hasn’t Syb been in the courtroom all this time?....why was she allowed in the courtroom while Z’s parents weren’t because they were going to testify?....maybe I’m confused as usual...

MOM has an unsealed redacted copy of the parent’s settlement

If he chose to...he could call her to the stand and talk about how she changed her story and that she has a financial bias.

Of course, he probably won’t do it because it would take great skill with HIGH RISK.

rumors are that it it more like 1.5 -1.75 million.

Crump probably got 1/3 of that

I've long suspected the State was trying to throw this case for several political reasons.

If it puts mommie dearest on the stand, my opinion will be confirmed.

There's little benefit to her taking the stand outside of trying to curry sympathy from the jurors....to the contrary, the risk of her saying just ONE no-no thing that provides an opening for the defense is ENORMOUS.

I hope the prosecution calls her, hah.

O'Mara will go gentle on Sybrina on cross exam. I think he'll ask when was the last time she saw him, heard him; how many days in the last two years did Trayvon live with her; who was in the room when the 911 call was played, who in that group was first to ID the voice as Trayvon's.

That's it. That's all I'd ask. All focused on basis for knowing the voice, and on any taint that might attach due to group hearing of the 911 call.

Then, when the state rests, I expect the defense will move for judgment of acquittal. That motion is probably 95% drafted, right now. It'll be summarily denied by Nelson.

The first witnesses I would put on the stand for the defense would be Zimmerman's parents, for screamer ID. After that, they can come into the courtroom.

It just looks like that because the evidence doesn't support the charge. I think the state is doing everything within its power to destroy Zimmerman, and that is a far cry from attempting to "throw" the case.
