If a defendant is asked “Do you intend to invoke the 5th amendment?” and he answers “Yes”, he’s waived his priviledge

The original Fifth Amendment protection was specified as protection from being compelled to be a witness against oneself in "a criminal case." How it got to be expanded to covering Congressional committee hearings IDK, but probably there has been a welter of case law around this, as the issue appears to remain unsettled.

The Dems are probably already shopping for a federal judge who will say she did not waive her 5A rights. It’s the way of the Dem (and not available for Repubs/conservatives).

Dershowitz is a very honest, principled, ethical man regardless of his political leanings. He is also gutsy and defies the Left if he needs to.
