IRS Could Revoke Non-Profit Status for Religious Institutions over Same-Sex Marriage

Based on Wednesday’s Supreme Court ruling, in which the Court majority determined that the Defense of Marriage Act’s federal definition of marriage had to incorporate state-based same-sex marriages, Internal Revenue Service regulations could be modified to remove non-profit status for churches across the country.

The DOMA decision makes clear that marriage is a state-to-state issue, meaning that religious institutions that receive non-profit status on the federal level but do not perform or accept same-sex marriages in states where it is legal could have non-profit status revoked.

Furthermore, should the IRS move to revoke federal non-profit status for churches, synagogues and mosques that do not perform same-sex marriage more generally, the Court could easily justify that decision on the basis of “eradicating discrimination” in religious education.

The Court stated in Romer v. Evans (1996) that states could not take measures to prevent future distinction of gays and lesbians as a protected class under state law; in Lawrence v. Texas (2003) the Court ruled that same-sex sexual activity was Constitutionally protected; in the DOMA case on Wednesday, the Court ruled that DOMA was unconstitutional not merely on federalism grounds, but because it violated the equal protection clause of the 14th amendment and the due process clause of the Fifth Amendment.

On the state level, a movement is already under way to revoke non-profit status for religious organizations that do not abide by the same-sex marriage. In Massachusetts in 2006, Boston Catholic Charities withdrew from adoption services thanks to the state mandate on same-sex adoptions, rather than fight the issue in court. In California, a bill is already making its way through the legislature to bar non-profit status for any religious youth group that discriminates on the basis of “gender identity, race, sexual orientation, nationality, religion, or religious affiliation.”

“Too many things involved like property, custody of children, etc. Marriage is the basis of our civil, as well as religious, society.”

Those reasons are why marriage and families are a thing of the past. Same-sex “marriages” produce 0 children, so I guess we’ll keep importing our next generations from abroad.

He was writing about civil divorce and remarriage at the time. His mitre would have spun off his head if someone would have explained ‘gay marriage’ to him. To the state in the modern era, marriage is simply whatever judges, pols, or 50% +1 of the voting public thinks it is at any one time. It was always a danger, and the longer it goes on the more people are conditioned to think that marriage comes from and is defined by the state.

Sounds tempting, but I don’t see how that deal works very well for us. It would be too easy for Obama to force confiscation that way.

I mean, it’s been done before - even in England which did that - it took another 200 years before they were able to restore the heirarchy with priests and bishops.

There has to be a better way that doesn’t give O the door open for confiscation.

That is the source of the erosion of Christianity in general; when Christian churches started wavering on reproductive/family issues in the first half of the twentieth century, the slide down the slippery slope began. Now here we are, with some “christian” churches applauding this ruling.

Our minister refuses to become embroiled in anything political on a direct basis, but indirectly he does have a way with words and an excellent vocabulary.

He also has never performed a marriage ceremony for anyone at anytime for any reason. We do, however, have a dedication of all new babies every other month. Lots and lots of them with a huge kids program from newbies to high school seniors.

I believe in the old days of wind powered masted ships when the Captain and crew saw the huge wave coming in they would steer into the wave, with anchor down in an effort to crest the wave and ride down the wake. If you take the wave sideways it will roll the ship and all is lost.
Steering into the maelstrom may seem dangerous but the same logic applies to driving the car. When it skids driving into the skid can help you maintain control even when your first reflex may be to stomp the brake. Question of nerve and experience.

Fine- flat and fair tax for everyone. No one should live in this country who doesn’t have an invetment in the tax strucutre in equal ways to his neighbor.

Contract law could be used to handle most of the mentioned issues such as is done in sui juris marriages(common-law marriages). Remove the State from the ‘marriage’ business and have contract civil unions be their domain while placing ‘marriage’ back into the religious realm.

What we are seeing transpire before our very eyes is a nation coming under GOD's Judgment or wrath. True we do elect our leaders or perhaps even that is fixing to be taken from us as well.

Nations who turn to GOD reap leaders who's hearts are not hardened toward GOD. Nations that turn against GOD are given time to repent. What is happening now caused two cities to be wiped off the face of the earth to the point their exact location is still unknown. Sodom and Gomorrah were given chances and even Abraham asked of GOD the cities be spared. Right now and I'm just guessing we are at about the morality point of ancient Rome which fell. How much further will the fall continue {again I mean the nation as a whole} before it stops?

The events which have unfolded since pre-WW2, the reestablishment of Israel be decree after WW2 and recognized as a sovereign nation, and the advances of communication, travel, and knowledge, point to a {as in the days of Noah or a Babylon {city} outcome.

I think Paul Weyrich hit the nail on the head in 1999 about we are no longer the moral majority. I believe his advice in how to deal with that fact was also wise. Take care of your families, support others in your community who are Christians, and still remain in the fight but with the understanding that with GOD's help we are on our own in this. Save your families and community. Establish Christian networks for the times coming even underground ones if necessary.

I don't think that's being doom and gloom but rather a rational reading of scriptures and past events. Not all of our Founding Fathers were Christian but nearly also believed in GOD and embraced Biblical morality and principles even the most liberal Thomas Jefferson.

The restoration of nations generally do not happen overnight or even in the frame of ones lifetime. There are some exceptions sure. Take away the rights an freedom or worship in this nation and in time it will begin to spread again like wildfire. But GOD such as in the case of The Exodus may not allow a healing of the nation until the generation of rebellion is dead. These are things we don't know.

I haven’t a clue. We do have Bible study groups for prospective brides/grooms and newlyweds which he leads, he just doesn’t do wedding ceremonies. We do have a whole lot of Bible thumpin’ JP’s in the area that are good conservative Christian men/women that I would not hesitate to ask to perform the ceremony if I were wanting to get married again.

The focus of the church is more on educating its members about the Bible and walking the walk.

I don’t think I have ever heard of a funeral service being held at the church either.

One thing I will have to say for our pastor, if you need him for anything day or night, he’ll be there. When my daughter was killed in an auto accident years ago he came to the house at 3 a.m. to pray with us and called me every day for several weeks, always closing our conversation with a scripture and a prayer.

Because The Church can only serve one master. LBJ as a senator pushed through a bill to silence the churches political dissent in exchange for no taxes. Most churches saw it as a good deal. Yes even Christ paid the required taxes for both Temple and Rome. The NPO status of churches has for too long been used by our government as a means to regulate the church, it's mission, and messages.

There are other alternative, some of which have been expressed on this thread: abolish the IRS, go to a flat tax, a sales tax, rescind Johnson’s legislation etc.
