Has Florida lawyer Joe Scarborough ever heard of double jeopardy? Indeed, such appeals are usually brought by a convicted defendant, so the entire premise is based on the similarity in race (or rather, the lack thereof) between the jurors and the *defendant* The "victim" isn't part of the picture.

Has Florida lawyer Joe Scarborough ever heard of double jeopardy? The Written Constitution is so 18th century that it's not worth reading, and it was obsolete even then. In the Living Constitution, double jeopardy is less important than diversity, since diversity is the centerpiece of the penumbra.

They really scrape the bottom of the barrel to come up with these folks. For him to say something so ludicrous he would have to be woefully ignorant of the most basic tenets of US law, or assume his audience is a cackle of complete morons.
I suspect it is that latter. After discussing politics with a few of them, I also suspect he is correct.
