I think the fact she stated, “she is over 900” employees is considered testimony. When one gives testimony, that is considered waiving rights to the fifth.

That is the same argument that the IRS gives against non-filers. If anyone files a tax return any time during their lifetime, it waives their right to discontinue filing later for any reason.

They can refer information on possible criminal activity to a prosecutor, which the prosecutor can either act on or refuse to act on. His choice.

Here's my take.

If she was allowed to stay, her “testimony” regarding her innocence would have been On the Record, but no hard questions would ever be answered. This way, her innocence can not be considered.
