I think the fact she stated, she is over 900 employees is considered testimony. When one gives testimony, that is considered waiving rights to the fifth. That is the same argument that the IRS gives against non-filers. If anyone files a tax return any time during their lifetime, it waives their right to discontinue filing later for any reason.

Congress can’t prosecute.
They can refer information on possible criminal activity to a prosecutor, which the prosecutor can either act on or refuse to act on. His choice.

Which is why it is stunning that the lawyer let her make that statement. I guess he has researched the law and determined that it cant be considered waiving her rights.
Or they decided there was nothing that Issa can do other than hold her in Contempt of Congress.

Here's my take.
If she was allowed to stay, her “testimony” regarding her innocence would have been On the Record, but no hard questions would ever be answered. This way, her innocence can not be considered.
Issa is right on this one. LOL!

Issa was on Greta last night - he said they were taking depositions under oath all day yesterday & have new info and LOTS of questions to ask today. That might be why he dismissed Lerner - didn’t want to waste time listening to the 5th every time a committee member wanted to ask her something. He said there would be a full day of hearings today.
