I think the fact she stated, she is over 900 employees is considered testimony. When one gives testimony, that is considered waiving rights to the fifth. That is the same argument that the IRS gives against non-filers. If anyone files a tax return any time during their lifetime, it waives their right to discontinue filing later for any reason.
