Lois Lerner, the IRS official who headed the tax-exempt division when the targeting of tea-party groups took place, plans to invoke her Fifth Amendment right to refuse to answer questions before Congress on Wednesday.
But Republican Rep. Darrell Issa, the chairman of the House oversight committee where Lerner was to appear, has issued a subpoena to Lerner anyway.
The subpoena was delivered after the committee received the letter from Lerner's attorney, a committee aide said.
Her attorney, William Taylor, said in a letter obtained by National Journal, that Lerner had "not committed any crime or made any misrepresentation" but that she would decline to testify at a House hearing on Wednesday.

So, if “...(she did)not committed any crime or (make) any misrepresentation...” why is she taking the fifth?
After she is sworn in she can plead the fifth all

If she pleads the entire time...she needs to be fired. It is intolerable to have an unaccountable bureaucrat, particularly in the IRS.
Plead the Fifth? That’s not very ‘Girl Power’ish. 0bama will probably promote her in exchange for not talking. She can now join the ranks of Sarah Ingram, Susan Rice, and everyone else who succumbs to bribery.
Ask direct, simple questions that would implicate her, 0bambi, Lew, the IRS generally, the Treasury Employees Union, etc.
Make her take the 5th repeatedly over simple questions that demonstrate her culpability. On tape.
They should hold her in contempt of congress if she refused to answer the question “Did Obama or the White House direct you to target conservative groups?”
Still, if the House does not Impeach Obama, then they are culpable as well. No excuse not to Impeach....let the Senate refuse to vote for conviction...we will have them on record

if taking the fifth leads to a presumption of guilt, then there is no fifth amendment right.
However, there is plenty of evidence that would serve to convict her without her testimony.
And if she refuses to answer the question if it was coordinated by the whitehouse then she should be held in contempt of congress.
I’m surprised Bonehead did not tell Issa to stop it.
Let her repeat the fifth until she loses her voice all while the camera’s roll.
Can one invoke the 5h only if one does not want to incriminate onself? Or, can one also invoke the 5th if one does not want to be Ft-Marcy-parked?

Wonder what her apology was for - maybe that’s what she didn’t a crime in or (make) any misrepresentation in. We are to know apologies are legal!
Exactly, she cannot claim the Fifth to protect another person. She can only claim the Fifth to not incriminate herself.
They are covering for the Dear Leader.
