Can’t fire them and for those that say prove it i say the state will go after the employer and force them to prove a negative. Does anyone doubt the judges in that state won’t rule against the business?

Good luck proving that. No employer would be dumb enough to admit as much.

The burden of proof is going to be up to the employer........and a nightmare for their HR and legal departments.

A disgruntled employee doesn't have to prove anything, all they need to do is file the complaint with the appropriate agency and let them do the rest.....

Well, not all the people of California elect them but all the people of California suffer from the results. California is huge, population wise and contains a lot of conservatives that suffer from the majority's decisions at the polls and some times when the people do speak out for what is right, the court ignores them anyway, (Proposition 8).

It's not always a simple thing for conservatives to "pack up and leave".

I know you didn't say, "pack up and leave" and I'm not talking to you specifically but as a resident of Illinois, I've heard it plenty of times.

In some ways, I envy those who have no family, job, property etc. tying them to a particular location but in most ways I don't.

If the businesses are incorporated (Inc.), they cannot be consolidated for OBozoCare consideration unless the IRS Tax Code is changed...which could and probably would happen.

Without Gov. Rick Scott my state will be in a whole bunch of trouble anyway.We are in for a heap of free lunch states until they fold under their own weight.

Now employers know, they have to cut back before this IDIOTIC BILL goes into effect.

For all intents and purposes, the bill is already in effect. The govt is using staffing numbers from 2013 to show whether or not a company is small / large in 2014 and thereby requiring a company to provide govt insurance.

All people are required in 2013 to have insurance, whether employer provided or not, and you will have to report that you have it on your tax forms when you prepare them in 2014.

That's why you saw so many companies lay off people, reduce their hours in early 2013. They were trying to get the reductions in prior to the "look back" time period that the govt will use.

Any employer that is small (< 50 eligible employees) is actually recommended not to grow their eligible employees more than 45. At least that's what our company was advised, and that was by our insurance broker.

What a freaking boondoggle.

A smart business would just move incrementally. Establish a business site in the desired state. Name it under some new LLC name and move key employees that can work remotely or hire new ones. Subcontract to the LLC not to the individual employee. After a few months operations could be moved totally. If it is assembly or manufacturing company it would be a bit more difficult but still could be done. And don’t even make an announcement until it is basically a done deal.

Sorry it works the other way. Now, anyone reducing hours is subject to the law and proving that wasn't the reason!

That was rude. ANV is obviously a conservative and outvoted by the liberal meccas on the coast. They are the ones that made the mess. If you look at the CA voting map, the interior is red while the coasts are blue.

Does 100% of the people in your state vote and think exactly the same?

Thank you for a logical rational post!

There ARE a lot of conservatives in blue states and many will leave after they retire. The exodus of retired white people from CA is obvious. But since CA pays higher than most other states, it is hard to move before then.

I know first hand power plant jobs in Texas pay at least 30% less than CA. And although Texans like to brag about how cheap it is to live there - with the confiscatory 3%+ property taxes - it really isn’t. And all the illegals make it unlivable, IMO. I’ll not move from the 1st most invaded state to the 2nd - that’s hardly any better.

How come those from other conservative states don’t brag as much as Texans? Tennessee and Oklahome have fearless state legislatures, as well as Idaho. Oklahoma has managed to pass an anti-illegal bill that has stayed on the books for years now. Tennessee’s property taxes are very low and they only have a state tax on capital gains and dividends. But I don’t see them being arrogant and condescending to others - and they have reason to be. (It’s because they are among the nicest people in the US, so that’s why I’m moving there and giving them all my retirement money!)
