Weve reported on Frank Lautenbergs knee-jerk Explosive Materials Background Check Act before, but now that the full text has been released people have begun to parse out exactly how bad this thing is. Unfortunately, since it simply re-writes existing law instead of creating new law, its fairly hard to understand all the moving parts. Jesse over at Predator Intelligence has a document he put together that shows how the EMBCA amends Federal law to screw over gun owners. Heres what I take away from this . . .
■Requires those who want to use black or smokeless powder to obtain a limited explosives license. ANY AMOUNT OF LOOSE BLACK OR SMOKELESS POWDER WOULD REQUIRE SUCH A PERMIT. Commercial small arms ammunition (finished cartridges) is exempt. For now. ■The bill redefines manufacturer in terms of explosives to mean anyone who makes something that goes boom, even if it isnt for sale or profit. Previously, you needed to be in the business of manufacturing to qualify as a manufacturer, which means making a profit from your endeavors. As the current law makes the manufacture of an explosive without a license illegal, this is pretty clearly a stab at making tannerite and other binary explosives that people assemble themselves illegal. ■It expands the factors that would exclude someone from purchasing explosive materials to include those who have a restraining order against them. ■Restricts those who are suspected of being terrorists or on one of the many secret terrorist watch lists from obtaining a license for explosive materials, turning the shall issue explosives permit process into a may issue permit at the Attorney Generals discretion. And they dont have to tell you why you were denied, or provide a means of redress.
In short, it looks like this bill is specifically designed to restrict the ability of those who load their own ammunition or use black powder firearms from buying the components that fuel their activities. Keep in mind that right now, gun stores dont need an additional license to sell black powder or smokeless powder. You can even buy it online and have it shipped to your door for a modest fee.
Should this bill pass, gun owners would need to pay $50 every three years to buy and store gunpowder. And gun stores would need a whole new set of licenses to sell the stuff. This is an immense financial burden to law abiding Americans involved with firearms, and doesnt do a damned thing about fireworks. Or pressure cookers.
Yep. Napolitano has a lock on all available ammo, and this ‘background check’ nails down the reloaders. That about covers it. National database complete.
If there was any powder available there would be a run on it.
Maybe it is time to learn how to make gun powder. Swaging bullets is definitely feasible, but setup costs are a bit high. Making primers is tedious but doable. I'm not worried about brass, if I shot my brass to failure, I would wear out the barrels on all my weapons.
Yeah, this will screw innocent reloaders and those of us that have been shooting black powder antique muzzle loaders (without killing anyone) for decades.

Before I left San Diego for Idaho, my wife and I would each shoot 300 rds a week. The brass would get "laundered" in the vibratory cleaner on Saturday night. I would reload 600 to 1000 rds on Sunday night while listening to Drudge. A box of 1,000 primers and two 500 count boxes of bullets would be consumed. It was revolver brass, so it all came home. A 1 lb can of powder cost $20. Ditto for 1,000 primers. At a nominal 5 gr powder per round, I could reload 1400 rounds with that single can. A box of 148 gr DEWC in .357 caliber set me back $27 for 250. The gun shop loved the business. I had a great hobby. That's pretty much eliminated by a meddling government...for no good reason at all. The indoor range collected the spent bullets and sold the lead to a bullet casting company. Everything but the powder and primers was carefully recycled.
And the damnedest thing about is that the Marathon bombers didn’t even use black powder from a reloading supply shop! They used powder taken from fireworks!

Aluminum cans, foil and tin cans now will be confiscated after usage by your local ATF recycling plant.
You bring up a good point.
I didn’t hear anything about the raid, did it turn up NRA and firearm paraphernalia? (But up until that point everything seemed to follow that prediction.)

Like the other prongs in the effort, it’s a class war against the Second Amendment for the rabble. And at the other end of the default process, we’ll all be members of the rabble.
After analysis, it’s an attempt to register reloaders, and more immediately, to cut off supplies for even longer. If consumers are wise enough, for the mere presentation of such a threat, the political/regulator class won’t get their hunting tourism season and revenues. Besides, save what you have, folks, and avoid expending it. There might not be any more.
Being insane doesn’t mean that you can’t be elected to the Senate or the White House.

Well, at least, this latest statist legalist action, is in well within the bonded legalism of the NDAA. Oh Joy! Vote Lt.Col. Allen West, what ever he runs for and however. Just remember- He runs for your emoted wonderfulness.
