The White House said Monday that the surviving suspect in the Boston Marathon bombing will not be treated as an enemy combatant, in response to calls from Republican lawmakers to consider that option.
The announcement came as a sealed complaint was filed against suspect Dzhokhar Tsarnaev. Fox News has learned that the suspect made an initial appearance in front of a federal magistrate judge at the hospital where he is still being treated. No plea was entered.
White House Press Secretary Jay Carney said the suspect remains in "serious condition" at the hospital.

Why is the Federal Government and White House commenting on this?
If it had been a Southern Baptist white guy born and raised in TX I’m sure he would have been promptly declared an enemy combatant with no constitutional rights.
That’s my big concern with the executive being able to unilaterally decide who is and who isn’t an enemy combatant.
It’s just too easy to arbitrarily circumvent then Constitution at the whim of one individual with no accountability.
Since he is a naturalized citizen, treason is more appropriate than foreign combatant status. Of course, that was left off as well.

I just got a low point in my stomach after hearing this on the radio news. He could have been questioned by the counter terrorism intelligence and then handed back for processing through the courts. I guess he will end up in Colorado prison and being interviewed by Oprah. He’s not a kid. The media has already begun his defense; it’s his age/mental illness. They now will wait until more are murdered before they act accordingly that we are at war with radicals.

He is being charge with using a weapon of mass destruction meaning his final destination will be either Terra Haute, IN or Florence, CO.

Good. Obama is about to reap the genuine disfavor of America, including the low info. voters who elected him.
After all, we do need to make sure not to offend our Muslim jihad supporting so called “friends” at home and abroad./SARC.
These evil men actually renounced all ties to the USA, whether legal immigrants or citizens. They renounced by theior activitioy to attack inocent men, women and children with weapons of mass destruction. They are not entitled to due process. They deserve to be classified as enemy combatants.
What Obama has done by this decision, is to inform America that the wanton slaughter of innocent Americans is not an act of war sufficient to renounce citizenship rights, when during WWII, citizens were treated as enemy combatants AND HANGED for merely working for the Nazis, let alone blowing up Americans.
Obama agains is showing us that he is a fascist.Now the entire country can see that.
