Several Republican lawmakers are calling for the surviving suspect in the Boston Marathon bombings to be tried as an enemy combatant, rather than as an ordinary criminal.
It is clear the events we have seen over the past few days in Boston were an attempt to kill American citizens and terrorize a major American city, read a Saturday statement from Sens. Lindsey Graham (R-S.C.), John McCain (R-Ariz.), Kelly Ayotte (R-N.H.) and Rep. Peter King (R-N.Y.). The accused perpetrators of these acts were not common criminals attempting to profit from a criminal enterprise, but terrorists trying to injure, maim, and kill innocent Americans. The suspect, based upon his actions, clearly is a good candidate for enemy combatant status. We do not want this suspect to remain silent.
Their statement came after Dzhokar Tsarnaev was taken into custody and sent to the hospital Friday night.
[snip] America is part of the battleground, he said. If you capture someone on the battleground, they should not be given the privilege of a civilian trial where they are given different rights...

American citizen on American soil. I’m not sure “enemy combatant” has ever been defined to include such. I don’t like the idea of the Obama Administration stretching that definition.
And the reason this is a silly view is because one day the Feds could do this to you.
So you want to allow the administration to disappear and torture mere suspects in America?

I’ve seen several stories on where he lived, but nothing at all about where either worked. What was the source of their income? There are more involved in this
I’m a youngen and not familar with the specific of the case but think that the constitution is clear and lists only 4 federal crimes
Everything else should be done under state law in my opinion.
McCain is the epitome of a political schizophrenic, I can’t predict what will come out of this man’s mouth.
Is there any provision in the Constitution that says we must wait twelve to fifteen years go serve justice on this subhuman vermin?
Would the Weathermen, KKK, Unibomber, etc be considered enemy combatants for their bombings as well?

What about charging him for insurrection under Fed law? I think that would be appropriate, as these Islamists have creating a caliphate as their motive and that’s the overthrow of our gov’t.
Not getting read your Miranda warning is not a get out of jail free card. It just means your statement cannot be used against you. They do not need an admission from him. They have plenty of evidence.

No, there are firearms and explosives statutes that overlap. They could actually start with a RICO prosecution and go from there.
I’m pretty sure that one of the “terrorist” type statutes that was passed since 9-11 gives the feds the authority to step in. Somebody reading this post can probably enlighten us.
Much like when an FDIC insured bank is robbed the state or the feds will take jurisdiction based on who has the better case and/or penalties.
Actually, he could be tried twice, once under federal and once under state law and receive two different sentences. But it becomes redundant.
They bombed a Federal building and Federal employees. Made it a Federal crime. Should that be? I don’t know, but it was the pretext.
I disagree. I think we could have sleeper cells in our country trying to get citizenship. You can’t do this with natural born citizens, but i think it needs to be looked at for others. He just became a citizen. It’s crazy he should get special protections.
Personally, I think it utterly destroyed it, at least for a long while.
