Woman who recanted rape claim likely to keep $750,000 settlement

A day after a former high school football star had his rape conviction dismissed, attention has focused on the woman who recanted the sexual assault claim she made 10 years ago.

Wanetta Gibson was a high school sophomore when she accused Brian Banks of raping her at Long Beach Poly High School. She and her family sued the school, receiving a $750,000 settlement, and Banks spent five years in prison after pleading no contest to forcible rape.

Even though a judge Thursday tossed out the rape charge, it remains far from certain if Gibson, 24, will face any consequences.

Legal experts noted it could be difficult for the Long Beach school district and its insurer to get the settlement back.

Then there is the reality of Gibson’s life.

Court records suggest she has few assets: She received public assistance for a time and her children, ages 4 and 5, still do, according to two suits brought by the county in an attempt to collect child support. Gibson, who could not be reached for comment, was ordered initially to pay a $600 a month toward their support. But in the last year, county officials said she didn’t have to pay anything, citing a lack of income and employment.

Did the government tax any of that award. If so, the government should pay restitution by returning the taxes to the original payer. Any disposable remainder spent by Gibson should be garnished from her income until it is fully repaid. How do you make restitution for 10 years of improper incarceration?

IIRC, some other cases have paid at approximately one megabuck per year of improper incarceration.

From the article (May, 2012), she recanted her 2003 accusation in 2011, and has since recanted her recantation.

Does she have any credibility left?

There was a time when I thought that turning a young man's life into a ten year nightmare that included five years in prison would be considered a significant criminal act in itself, with or without any "monetary settlement." But the Duke lacrosse case and other similar cases have enlightened me. False accusation of rape is simply not considered a crime in the United States, or at least not a serious crime.

Time for a Freeper to say, "The sentence for the false accuser should be the same as the sentence that her non-rapist would have received!" Great idea, but that never happens. The average sentence for a rape conviction is over eight years, with average time served over five years. In the few cases I have seen where the woman was actually prosecuted and convicted, the sentences were under a year, heavy on community service and light on imprisonment.

She should have to pay the accused back the money she got x2, and then serve his sentence, x2 as well.

I really want to cry right now but can’t.

Haven’t cried in 8 years since my wonderful 15 year old Tuxedo Male cat died.

I found him when he was a baby and eyes barely open and he thought I was his mom and/or dad. He would chew on my shirt in an attempt to “nurse”

I’m all he ever knew his entire life with the exception of occasional female week end/week long guests and a few family and friends.

Max was truly one in a million. Smarter than most people and all liberals.

I hope he’s waiting for me at the Rainbow Bridge.

Yes, I do think the jailed man should be paid for those lost years.

As for “taxpayers”, if the sorry Libtards had not elected other libtards who passed FemiNazi agenda laws, that man would not have been in jail. When “Her word” is worth more in court than “His word” we have willingly departed from the core constructs of America and accepted Libtardism.

America once had the core construct of “innocent until proven guilty”, but that was disgarded in favor of FemiNazism/socialism.

Welcome to the “sexual revolution” - guaranteed to be very revolting, indeed. Unless you agree with jailing an innocent man for 10 years, that is.

The man was wronged, damn it! Make him whole -OK?
