I just talked to someone familiar with the Toomey-Manchin proposal who raises a serious concern based on his understanding of the legislation.
Everyone on all sides agrees that we need better help for those with mental health problems who need treatment.
Unfortunately, the person I talked with is concerned that the Toomey-Manchin proposal could discourage people from getting help.
The proposal will allow a doctor to add a patient to the National Instant Criminal Background Check System (NICS) without ever telling the patient he or she has been added.
There would be no due process requirement. Not all doctors will be able to do it with the same ease, but many will. Knowing a doctor could add him to a federal database as mentally ill without his knowledge could potentially dissuade a patient from going to the doctor in the first place to get help.
Worse, if the doctor does so and makes a mistake, the patient would have to actively work through the system to get himself removed guilty before being proven innocent. In some states, should a doctor flag you as having mental illness without your knowledge, you may very well see the state come collect your previously purchased guns.
Activist mental health providers will probably be overly aggressive in adding people to the list. Give it five years in liberal areas and people who believe in the physical resurrection of Christ will probably get automatic entry onto the list.
Mental health is a serious issue and the Toomey-Manchin legislation could have negative consequences. Worse, it would still not stop a Columbine, a Newtown, or the daily massacres in Chicago.

Who will report the doctors?
In Amherst, NY this week. A gun owner saw his handgun license revoked by order of the NYS Police. The town clerk had to revoke and seize his permit for being on psych meds. Only a couple of days late the state gestapo informed the town clerk that they’d made a mistake and gotten the wrong individual.
How is it that New York State can avoid the HIPPA laws and have law enforcement search patient records without patient permission?
This will affect normal people who mention that they are feeling low on the day of the office visit, and not affect people with serious problems. This will lead to more mass shootings, which is the original intention of this mad proposal.
Then they will say “see - now we gotta take all your guns away”
So what follows... Mandatory mental screening for all Americans?

While they presented it with the deceptive ‘protecting patient privacy,’ what it really did was set up the interchange of patient data among many federal agencies.

Can’t win situation for people now. If you go to the doctor and act cheerful, the prognosis will be that you have delusional tendencies.
It is easy to see why Obamacare was a necessity for the the marxists. They are going to use it to take over your life.

First, we need a very clear definition of what is ‘crazy.’ We are all assuming that we all agree that ‘crazy’ means someone who is not in control of their actions and therefore presents an immediate danger to themselves and/or others.
That is NOT the definition that the leftists/statists/communists/socialists WILL be using if they incrementally obtain control over the 2nd Amendment.
If you have a child on Ritalin, does that mean the father shouldn’t have a gun in the house, even if it is locked in a safe?
If ten years ago you asked a doctor for something to take the anxiety out of flying, are you considered ‘crazy’ and therefore banned from owning a gun?
If you mistrust this government, is that a sign of ‘paranoia’ and therefore a mental illness?
If the militant homosexuals succeed in branding anyone who doesn’t smile when they see them in all their glory in the public sphere as a ‘homophobe,’ is that ‘phobia’ a sign of mental illness?
If you believe in the miracles of Jesus, are you a ‘crazy?’
Do NOT allow them to control the language. If you do, they will win the argument, because they change the meaning of terms continually to suit their needs.
Where do I go for these free trips to Hawaii? I can’t even get pens or post it notes from the drug reps. He’ll I haven’t SEEN a drug rep in the hospital for years.....

And let’s not forget the AMA may resurrect the old 1990s practice of attributing every physical ailment to “stress.” This opens the door to connecting millions of Americans to the mental health route to denying gun ownership.
This is not going to end well.

HIPPA doesn’t do a damn thing except keep your family from knowing about you.
Firearms owners who are concerned about "issues" will have to decide: Would consulting with a mental health professional for an hour do enough good to be worth losing forever their right to hunt and their right to defend their families, not to mention their right to defend their country against all enemies, foreign and domestic? I think that will prove to be an easy one to answer, particularly after a few more ordinary, decent people get raided in response to leftist psychologists and psychiatrists in a panic.
I suspect those doctors in Wisconsin that handed out medical excuses for demonstrators would routinely submit the gun denial paper work for all patients.
What other Constitutional rights can we put to this test? Clearly many liberal (er, “progressive”) talking heads are downright irrational and we should give a doctor the power to suspend their right of free speech and of publishing their screeds. I think people who are in the “low information” demographic are more dangerous than anyone with a gun. As long as we are opening up all unalienable rights to the physician’s veto, that should be looked into as well.
Unfortunately for America and our future, those so-called ‘news commentators’ put their personal, disgustingly liberal views on the news articles to the point where they take on the mantle of editorializing.
When the unwashed and uneducated hear these commentators with credentials like Al Sharpie and Rachel Madcow, they believe they’re hearing truth.
