I just talked to someone familiar with the Toomey-Manchin proposal who raises a serious concern based on his understanding of the legislation.
Everyone on all sides agrees that we need better help for those with mental health problems who need treatment.
Unfortunately, the person I talked with is concerned that the Toomey-Manchin proposal could discourage people from getting help.
The proposal will allow a doctor to add a patient to the National Instant Criminal Background Check System (NICS) without ever telling the patient he or she has been added.
There would be no due process requirement. Not all doctors will be able to do it with the same ease, but many will. Knowing a doctor could add him to a federal database as mentally ill without his knowledge could potentially dissuade a patient from going to the doctor in the first place to get help.
Worse, if the doctor does so and makes a mistake, the patient would have to actively work through the system to get himself removed guilty before being proven innocent. In some states, should a doctor flag you as having mental illness without your knowledge, you may very well see the state come collect your previously purchased guns.
Activist mental health providers will probably be overly aggressive in adding people to the list. Give it five years in liberal areas and people who believe in the physical resurrection of Christ will probably get automatic entry onto the list.
Mental health is a serious issue and the Toomey-Manchin legislation could have negative consequences. Worse, it would still not stop a Columbine, a Newtown, or the daily massacres in Chicago.
Senators Cruz, Lee, Paul and liberty defenders step up and do your work for the constitution. Kill this bill deader than Toomey, Manchin and Obama's scruples.
Let's give these two peas the benefit of the 'doubt.' Perhaps they hadn't time to read what their bloated staff hammered together.
The problem with legislators is that they continue to legislate and any cobbled piece of crap will do.

Anyone with any foresight at all could have at least seen this coming soon after the Newtown event.
It even appears that you couldn’t even make the connection until stories came out in New York about officials implementing their own brand of medical diagnosis and guns.
Sheesh...it doesn’t give me much hope it people like you on our side are so slow to the uptake on this stuff.
Stop reacting, start predicting and then act - soon.
You must consider the fact that MANY of the gaggle comprising the electorate are very slow on the uptake and any attempt, albeit rather late,, to enlighten them is a plus.
How long before Christians are herded into the boxcars? There are millions of people in this country who would LOVE to see such a day...
Doctors can already do this, although not as easily.
The regime is adding more informers to its secret police.
What everyone is mostly agreeable on....is that crazies shouldn’t have access to guns. I would agree, if the crazies find out they lose their gun rights....they won’t seek any treatment, and we will merely double-up on gun incidents.
It will probably happen. Fortunately, a high number of Christians have already procured their 2nd amendment supplies to make it as difficult as possible for those powers to do so without significant cost to their system.

You'd be surprised, how easy it is to CYA. Especially for a doctor. They'll all do it broadly just for the liability factor.
Toomey was one of the most deceitful of the “conservative” Republicans. He may want to be Lugar II. But PA is so liberal and he barely won in 2010.
Would that be the same Dr. who cannot get you on blood pressure drugs fast enough?
Would that be the same Dr. who gets free trips to Hawaii to set in on Drug Companies presentations?

Rick Santorum is continually bashed here on FR for his “non” support of Toomey.......he didn’t go out there and cheerlead for Toomey, the ultimate conservative, I was told here on FR. That was reason enough to bash Rick Santorum endlessly.

I disagree with the premise.
I disagree that a list is going to help.
I disagree that mental health ought to be considered in discussion of God given rights.
I disagree that doctors ought to have serious influence in anyones need or desire to own a firearm.
Stick to the second amendment and all this other stuff goes out the window.
I don’t recall reading a long list of restrictions related to the Second Amendment and who could exercise that God given right.
Please notice the recent emphasis on “mental health” by even those supposedly supporting gun rights. A suggested problem/crises looking for progressive solutions.

Exactly. These legislators think they are so smart but they’ll end up just getting more people killed. It’s time to kill this bill.
This is more worrisome and a major reason for background checks, registration (HIPPA) database & and ultimate confiscation:
psychotropic meds... who hasnt taken some of em, at sometime? Even a ‘sleep aid’ for a week or two...

But they can report a gun owner to the FBI.
