AMHERST, N.Y. (WIVB) - The NYS SAFE Act is billed as a necessary law to protect the public and keep guns out of the hands of the wrong people.
But Hamburg attorney Jim Tresmond says his client was notified by letter that his gun permit was suspended upon the recommendation of State Police, who learned the man is on anti-anxiety medication.
"Claiming that he had taken some psychotropic medications, and that he no longer could be eligible for the pistol permit," Tresmond said.
The permit holder lives in Amherst and Tresmond accompanied the man as he turned in his seven handguns used for target-shooting to Amherst Police.
"A law-abiding, honest, hard working professional, who never had one wit of scandal associated with him, criminal or otherwise. And they took his guns away," Tresmond said.
Tresmond is one of the attorneys already suing the state over passage of the SAFE ACT, which at the time was the toughest gun control law in the country.
Tresmond says his client once took a prescribed medication for his anxiety but he is not mentally ill. The Amherst man ended his prescription use within the last year.
"He is a law-abiding citizen, no record. He is a stellar member of the community, I would say. Not an ex-felon. He is one of the nicest young men I have met in a long time," Tresmond said.
Officials confirmed state law permits the suspension of a gun permit before the permit holder even gets a chance to state their case.
We have not been able to reach State Police to comment on this case but we do know Erie County officials have only taken action against one pistol permit holder on mental health grounds since the SAFE Act was passed last month.

Sleep disorders here. Doc gave me Ambien. I quit walking in my sleep in my late Twenties. Ambien brought it back, big time. Almost burnt down my house “sleep cooking.”

People should make sure they keep an eye on their medical records because things could easily be planted on those records.

While I do not consider myself a libertarian, I do not think there should be any laws restricting gun ownership. They simply do not work.
Consider the political espionage and extortion we have opened the door to now that the police have access to your medical records.

There was an article on FR some time ago about a lady in San Antonio who was on Ambien. She had a few drinks before taking it an going to bed. She got in her car, hit someone head-on and killed the driver. She had no clue she was even on the road.
Indeed, especially since the commie teachers are churning the nut buckets out of our schools as fast
as they can. Graduates today have no patriotism, no piety, no empathy, and no scholastic skills.
We will be a very long time, if ever, restoring our country after we throw these godless, evil bastards

That’s very strange because PTSD is an anxiety disorder. So, I cam not See how Xanax would cause adverse effects.
I have heard Xanax is bad for those with psychosis, but PTSD is not psychosis, it’s a form of severe anxiety to a life threatening event/s.
The only reason I don’t agree with this is the right to his medical history privacy!! OTherwise, I wouldn’t cry if they took away guns from people on anti-anxiety drugs...

The article states that Xanax combined with alcohol use is dangerous, Xanax does not PREVENT PTSD. It also highlights that Xanax is addictive and those suffering may have more anxiety and distress when trying to discontinue use. That is why they are concerned because of addiction.
I am going to be following this to find out how his PERSONAL medical info was made known to the state police. Talk about a huge HIPPA violation.
Many vestibular and sensory processing damage patients are not phobic in a true sense. The triggering offenses make the person to simply want away from the trigger. Therapies such as Cognitive Behavioral Therapy are of little value because again this is a non phobic and non traumatic event triggered disorder.
Go to a kids sandlot baseball game and watch the kids play. Most kids can track the ball and swing and hit. A Vestibular or optic sensory patient will do one or all of several things consistently. Swing too soon, swing too late, or duck away from the ball they should be hitting. I’ll do you one better though. It often shows up in how a kid or adults shoes wear out. When I was a kid my parents bought me a pair of shoes sometimes as often as once a month. I broke the sides over. Now as an adult I wear high top work boots with custom corrective insoles. Vestibular patients tend to walk off balance. I could never pass a straight line field sobriety test.
When I was a kid I had inappropriate sensory responses. Certain visual things that scared me I stopped up my ears. I also had extreme fear of thunder and fireworks. By age 7 the eye doctor told my parents I was one eye functional. Bt age 13 I was in a school for kids with physical disabilities to try and correct my coordination. They managed to get a considerable amount of it improved to where it wasn’t as notable. BTW I also passed the Armed Forces entrance physicals twice for two services.
I’ve had full blown General Anxiety Disorder for 18 years. I’m now 55. With this I also have what is called Myoclonic Seizures. When I have an attack it’s like being hit with a bucket of ice water or an electric shock. It produces a very severe upper torso spasm as many as several a minute. As I understand this degree of it is rare.
A book called Phobia Free by Harold Levinson MD pointed me to all this. He is a research Neurologist / psychiatrist and back in the 1970’s discovered a significant portion of his anxiety patients had Vestibular damage histories. You have to go back even to earliest childhood. Such things as chronic ear infections and/or sinus allergies can cause the damage. I had PTSD it hit me the same time the GAD hit. That made an accurate diagnoses more difficult in my case. PTSD IMO is best treated by one on one therapy sessions with a good LCSW who specializes in PTSD and anxiety. It takes time. I took me almost 5 years.
Doctors should not write Xanax to persons who have more than a single rare drink like a small glass of wine or a beer. The lower the dosage the lower the risk of problems. For PTSD though Klonopin would seem a wiser choice. What you want is low level but consistent in bloodstream.
