SAN DIEGO — For the first time in more than a decade, a U.S. Border Patrol agent will go on trial today on a charge of beating an unauthorized immigrant who was in custody after being caught trying to enter the United States.
Agent Luis E. Fonseca has pleaded not guilty to the single charge handed up in an indictment last year: deprivation of rights under color of law.
Prosecutors say a videotape shows Fonseca kneeing and choking into unconsciousness Adolfo Ceja Escobar just before 8 p.m. on July 26, 2011.

Agent Fonseca should be accorded the privilege of punishing Yellow Journalist Moran in a similar manner to that “unauthorized immigrant”.

If the guy used excessive force, and choking someone on the ground into passing out is a bit excessive, he needs to fired. He represents the United States, and all police should be polite and beyond reproach.
And the illegal immigrant should serve some hard time at hard labor to make him never want to break the law again. Expecting our officers to risk their lives for a revolving door judge is foolish.

Bottom line of my objection was the wording:
He is not an “UnAuthorized Immigrant”.

a shoplifter an unauthorized customer;
a trespasser an unauthorized tenant;
pickpocketing unauthorized withdrawals;
and a rapist an unauthorized lover.
From what I understand, Mexican border patrol agents on their southern border have authority to shoot to kill.
Use whatever force necessary even if it goes as far as killing them!

The border patrol agent was defending this country against an invader. But he should not have beaten the guy, he should have just shot the attacker and thrown the sorpse back over the border.
There is no such thing as "illegal aliens" they are in reality, Un-uniformed enemy combatants and should be treated as such accordig to the Geneva convention.(shot as spies)
Anyone entering this country illegally should be killed. They are attacking us and we should respond to that attack.
Just taking their lessons from Dear Leader wherein it is OK to drone someone to death but wrong to water board them to gain information.
Ceja, who was deported to Mexico, was arrested again a month later at San Ysidro, trying to get into the country. What I find odd is he did not report this to mexico officials,who would have been all over this ?
