On CNN, analyst Jeffrey Toobin predicts that "DOMA's in trouble": was repeatedly concerned that the Defense of Marriage Act violates state's rights."

Toobin then got hit in the head by a falling umbrella.

SCOTUS should ask one question. If we removed the word marriage from the legal lexicon, left that to religion and just called this a domestic partner act, would that be acceptable to the gay community?

My bet is the answer would be no and that is all SCOTUS would need to hear before declaring DOMA valid and prop 8 ahot down.

This isn’t about gay marriage. This is about the destruction of the church and the forwarding of a repressive body politic.

I really agree with you.

Personally, if I thought there was a rat’s chance that this case would really be about the states exercising their rights and it meant that the Feds could no longer impose their will onto the states then I would say great. Let Georgia write its own law on the matter.

The problem is that they want it to be states’ rights in THIS one case and who cares about the future.

Pyrrhic victory if DOMA goes down since that renders California's Prop 8 as Constitutional.

If they don’t succeed in redefining marriage at the federal I don’t see how the feds make much headway in states where gay marriage ils illegal.
