Jailed for Nonpayment of Child Support - But it's Not His Child

I got hosed by a my crappy attorney, lost the kids and ended up paying 75K over three years. During that time I made it a point to spend every minute possible with my kids which meant driving to their mother’s house every day to take them to school and then bring them back in the afternoon, attend every school event possible and basically kissed her arse being available to take care of them when she or her parents couldn’t.

Once she started dating again she asked me to keep the kids more often until it grew to the point they were with me at least half the time.

I let this go on for close to a year and watched as she pulled one stupid stunt after another with the kids, documenting them all. When she took a job 100 miles away and was leaving the house every morning at 6:00am and not getting home until after 7:00 I filed for a revised visitation and child support based on what it had become.

My older son was 12 at that time and was begging me to let him talk to the judge and his mother knew it. She didn’t fight and I ended up with just having to pay the equivalent of half their health insurance but more important, both kids (grown men now) are thankful that I provided a refuge for them from the abuses of their mother’s side of the family.

I know of one case personaly. The women cheated on my friend. When the kid was born, he had the wrong blood type. It took my friend three DNa tests in two states, numours court appearances, and three years of child support to get it stopped.

He never got the money stolen from him back, and is scared that someday it will start again.

Don’t understand what good it does to imprison anyone who is in debt or fails to pay child support.

How does languishing in jail provide money for child support?
And when he gets out and still can’t find a job; does he get thrown back in again?

Do we still have debtors’ prisons?

I know the law is supposed to have a deterrent effect, but the law is an ass. And, before you ask, I’ve never had to pay child support.

I blame the men.

Well, there's a shock.

Men need to stop being naive when a woman is pregnant.

Women are more sexually active now there’s no assurance they’ll be faithful men know this. Why sign a birth certificate first before getting a dna test.

This is exactly the kind of twisted rationalization for failing to hold women accountable for their own behavior that makes reasonable people regret having given women the vote. Also, I don't believe that the birth certificate needs to be "signed" by the man. The mother needs only to name the father, and the man has the burden of proof put on him to prove he isn't the father, and he only has a small window of time to do that

I actually am holding women responsible by having men get a child dna tested after its birth. Too many men wait til crap like this happens to ask for a dna test.

Paternity fraud doesn't exist thanks to Roe versus Wade.

Roe versus Wade says that a fetus is not a person, more like a lamp shade, or some other type of non-living item. As far as I know, lampshades are incapable of possessing anything, much less a "father". Roe versus Wade essentially eliminated fatherhood because one cannot have a father at conception, then not have a father during pregnancy, then suddenly possess a father again when born. If someone is to prove paternity, that proof has to extend the entire time back to conception. Only by overturning Roe versus Wade can this be legally accomplished. One cannot be a father, then not be a father, then be a father again. It's all the way through or nothing at all. Child support cannot stand this legal challenge if put forth.

Crappy attorneys are the worst of all slime balls.

Divorce court is not ‘fair and just’ - it is two slimeball lawyers fighting each other untill all the money is gone.

Freeper lawyers excluded for obvious reasons- I’ve met some good ones on here - the kind I wish they all would be

I've seen your story played out.
I have also seen the flip side. Many times.

Which is why I spent money I couldn't easily afford to ensure the biological “father” of my child was openly on legal documents as having expressed full intent to abandon “our” child.
That way, he could never come back into our lives, and blackmail me, or my child, with intermittent threats to seek paternal visitation rights(which can't be easily legally severed in my state)whenever he got kicked out of his latest conquests house.

And no, I was never eligible for any government “childcare benefits”, nor did I ever have any financial “child support” from the biological father.

OTOH, I didn't have to spend the past 18 years in and out of courts, trying to collect child support money that wasn't forthcoming, or worrying that some low life violent man had a vested interest in me being worth more dead, than alive.

Bizarre, isn't it?

We both are forced to pay taxes for a government system that is wholly unjust.

For every horror story you may have, I can relate a flip side, with the mother as the victim.
No court really gives a damn about the fate of the child.
The child is just the justification the courts use to control court fees for the parent with the most money.

The system is broken, and there is no justice for anyone, anymore. Hasn't been for many years.

When I argue with someone who is pro-abortion I say to them “If a woman doesn’t want the kid, she aborts it. If the man doesn’t want the kid, he still has to pay child support for 20 years. So why shouldn’t a man be allowed to force a woman to get an abortion or she agrees to no child support?”
