A New York attorney is taking the complicated process of picking a jury to a new extreme. He represents a suspected terrorist and asked a judge to keep Jews off the panel.
Inside Brooklyn Federal Court, attorney Frederick Cohn told Judge Eric Vitaliano, Im not wild about having Jews on the jury in this case, CBS 2s Steve Langford reported.
Abdel Hameed Shehadeh, a Muslim, is charged with making false statements in connection with a terrorism offense. His attorney told the court he didnt believe his client could get a fair trial if Jews are on the jury. For the record, Cohn is Jewish.
A 1986 Supreme Court ruling held that jurors cannot be excluded solely on the basis of their race.

Is that even legal? How is that not a hate crime like everything else seems to be?
There is so much law against doing something like that, it isn’t funny. You can’t even use peremptory (without reason) challenges to exclude people on basis of race or creed.
Judaism is a religion; Jews are a race.
Cohn could have conducted the jury selection (voir dire) by using up his all allotted rejections without cause on potential jurors he thought were Jewish, without specifically saying why he rejected them. In that way he may have had to eventually accept a couple of Jews on the jury but could have minimized their numbers without getting himself into this hassle. He may have been pleasantly surprised - from his perspective - if any Jews that may have gotten on the jury were leftists.
I'm not condoning him for this mentality, but he could have handled this concern of his more adroitly by being more subtle about it.
Perhaps he expected a more sympathetic approach from lefty media, whom he had reason to believe would be sympathetic to his Judenrein jury approach.
Been thinking about this one off and on today ~ maybe he doesn’t want to take the case and has gotten cold feet.
I’m with Eleutheria5 on this one, a first year law student knows this won’t fly, hopefully. But today apparently an experienced attorney thinks it might, or perhaps raise an appeal issue. At the very least, not be an embarassment to raise the issue. That’s a shame.
Potential jurors perhaps having read this and similar articles, perhaps he wants jurors, Jewish and otherwise, to get cold feet during deliberations. Clearly the motivation of any Jews on the jury are now suspect.
There are plenty of crazy Obama supporting Jews that would be ready and willing to let him go. Whats the problem?

We do have both fools and traitors among our religious brethern. Best to let them expose themselves in the media. Saves us time checking into their communist affiliations.

No, that’s not quite it. Unless you seek to dispense with the term “race” altogether, which may not be a bad thing. The name “Jew” does come from the tribe of Judah; in the Bible, the word “Yehudi” is translated “Jew” (i.e. whereupon other names so conjugated would have the suffix “-ite”, e.g. Canaanite for K’naani).

Can we ban nonChristians when a man is sued from a homosexual based on religious grounds?
