Women shot during LAPD ex-cop manhunt had no warning, lawyer says

A mother and daughter who were mistakenly shot by Los Angeles police hunting for rampage suspect Christopher Dorner had no warning before bullets started whizzing through their newspaper-delivery truck, their lawyer said Friday.

“No command, no instruction, no warning. They just opened fire on them,” said Glen Jonas, who is representing Emma Hernandez, 71, and Margie Carranza, 47, in possible legal action against the LAPD.

“They had no idea what was going on. They’re huddling, covering up and praying and hoping they’re not going to die.”

Both women survived. Hernandez, shot in the back, was in good condition Friday. Her daughter suffered a hand injury during the shooting and is now physically fine, but emotionally scarred, Jonas said.

The LAPD admits the predawn Thursday shooting was a case of mistaken identity that unfolded while police were guarding the Torrance home of someone named in a manifesto that ex-cop Dorner posted online about his twisted plans to avenge his firing.

Chief Charlie Beck said the officers saw a vehicle that matched the description of Dorner’s, driving through the dark streets with no headlights – and a “police-involved shooting” ensued.

Jonas said the women’s blue Toyota Tacoma looked nothing like Dorner’s dark-gray Nissan Titan, but that even if it had been a match, the police should not have fired on it.

“They still have to give the guy an opportunity to surrender. You can’t just execute him,” the lawyer said. “It’s in these high-stress situations where you follow your training and they violated every piece of training they ever received.”

The LAPD had no comment on Jonas’ claims.

He said he expects the city will offer his clients a substantial payout; if not, he plans to file a federal civil rights lawsuit.

“Thank God they didn’t die. It’s a miracle they didn’t,” he said. “If it was a movie, you wouldn’t believe it.”

Of course, she was ‘resisting arrest’ and the cops felt ‘threatened’.

I remember that, what a despicable show of force by UNION member "cops"

I'm a native So. Cali and had a run in with UC detectives in the late 70's when I was a teenager.

Long story short, all four of them got fired.....I have no love for L.A. cops or any others for that matter.

Thanks. I wondered if they could be charged with attempted murder.

There was obviously no "Stop or I'll shoot" order given. There was no identification of the subject. The majority, if not all, the bullets entered the back of the truck, where it would have been impossible for the subject to target them without sticking his gun or head out the door. There is no doubt in my mind that they intended not to arrest whoever was in the car but to kill that person. The intent to kill was clearly present. Their actions were unlawful because they failed themselves to follow the law.

Attempted murder is an attempt to kill a human being with malice aforethought and without legal justification.

Had they only shot a couple of rounds I think they might have been able to claim negligence. But 50 or more rounds without a single shot being returned is clear evidence that their intent was to execute the driver and not to detain him, arrest him or anything else. This was an execution. Luckily for everyone nobody was killed.

IMPO, These guys are in some serious $#!+.

Think they will actually face any criminal punishment?

They probably won't go to jail, but they'd better plead to some lesser included offense or they will do some serious jail time. Aggravated assault or something. If it goes to trial, these guys are going down.

What charges? On the State level:

Reckless endangerment and attempted murder would do for a start. Then there’s the Federal one that could be laid.

Google up 18USC242. That one carries a possible life sentence without parole. That’s the one I’m in favor of.

Seriously, how high can the percentage of “good ones” can their be?

Not just in that area, but up in our neck-of-the-woods, too. I used to think there were just a few "bad apples", but the older I get the more I think it's the other way around.

People keep referring here to LAPD cops doing the shooting. Weren’t they Torrance PD?

It was LAPD guarding a home in Torrance.

I am surprised that they could overreact this badly.

I’m not surprised that these unfortunate women were targeted by the 70 IQ cop clowns from liberal LA.

This is exactly the kind of cluster flock I expect from our idiot overlords and their incompetent, ill-trained gestapo. I’ll be kind and not comment on their marksmanship. When cops target everyone, everyone will shoot back. Should TSHF, I wouldn’t be shocked to see politicians, cops and bureaucrats hanging on lampposts from sea to shining sea.

Man, I’d like to be the lawyer on this one.
I’d demand it go to a jury trial and demand a billion or so in damages.
Own me a bunch of cop stations and police equipment not to mention a part of city hall.

A thought just occurred to me as I was reading this and all the comments.

Just saying, thinking, perhaps will be attacked for saying so, but what if he is creating this havoc just to prove how the LAPD deals with things.

Just a thought.

His “manifesto” did not seem like a madman to me. More like a hollyweird script. I will bet my bottom dollar they will make a movie of this....of course whitey will be the bad guy.

However, he indicated EVERYONE. Sounded just like me. I am not a racist, I hate everyone equally.

Many years ago I remember a guy robbed a McDonalds with a basement. He shot at a cop and retreated to the basement, I think maybe the cooler.
They went in and shot him about 40 times.
You just knew he wasn’t coming out alive.

Funny seeing fellow conservatives that know the same music that I grew up with. I mean 89 I was 17 and I lived in a lilly white community but boy did we love NWA when they came out. And what is funny is in 92 when the Rodney King riots happened we knew why the African American Community exploded. Just listened to what NWA had been saying for 5 years. Not saying the riots were just, just saying we understood why they happened. Funny thing is Eazy E and Dr Dre both supported on of the Officers on trial. They also thought people were acting stupid. But they also understood the frustration in the community.
