Texas Proposal: JAIL Any Federal Officials Trying to Enforce New Gun Restrictions in the State

A Texas lawmaker says he plans to file the Firearms Protection Act, which would make any federal laws that may be passed by Congress or imposed by Presidential order which would ban or restrict ownership of semi-automatic firearms or limit the size of gun magazines illegal in the state, 1200 WOAI news reports.

Republican Rep. Steve Toth says his measure also calls for felony criminal charges to be filed against any federal official who tries to enforce the rule in the state.

"If a federal official comes into the state of Texas to enforce the federal executive order, that person is subject to criminal prosecution," Toth told 1200 WOAI's Joe Pags Tuesday. He says his bill would make attempting to enforce a federal gun ban in Texas punishable by a $50,000 fine and up to five years in prison.

Toth says he will file his measure after speaking with the state's Republican Attorney General, Greg Abbott, who has already vowed to fight any federal measures which call for restrictions on weapons possession.

Toth concedes that he would welcome a legal fight over his proposals.

"At some point there needs to be a showdown between the states and the federal government over the Supremacy Clause," he said.

The Supremacy Clause is the portion of the Constitution which declares that federal laws and statutes are 'the supreme law of the land.'

"It is our responsibility to push back when those laws are infringed by King Obama," Toth said.

Texas is the second state to propose a measure to shield the state from the impact of any gun possession restrictions imposed by Congress or by Presidential order. A similar measure was introduced in Wyoming last week.

I pity the fool who is sent to confiscate the abundance of fire arms along the Texas/Mexico border. They should check with the Census lady who was almost killed by a watch hog, a javelina trained to attack anyone who came to the door of a mobile home parked out in the desert.

The hombres who inhabit that no-man’s land have creativity. No one would ever find the bodies.

TX maybe overcome with immigration (from other states).

We need checkpoints at the border to check immigrants' vehicles for guns and ammo.

And if you aren't bringing in *enough*, we turn you back. :-)

We have professional buzzards too. You don’t need to bury fleshy parts — in fact, it’s counterproductive. :-)

And whatever scraps of dna the buzzards miss, the fire ants get.

In 1851 Massacussetts, New Hampshire, and Ohio passed nullifications of the Fugitive Slave Law of 1850 as well as ordinances which would punish anyone who cooperated with the FSL with punishment twice as harsh as the penalties of the federal law imposed for failure to assist in the recapture of a fugitive slave. Sounds like soeone in Texas knows their history. Now see if they follow through.

Just for giggles I checked the number of registered hunters in Pennsylvania.... 1.3 million...think that would make us the 8th largest Army in the world....

Mark my words, Texas will be at the epicenter of the next civil war. Just the other day, a Texas rep promised filing articles of impeachment if this petty dictator tries unconstitutional executive orders to strip 2nd Amendment rights from us.

It would not surprise me at all if PA passed such a law. We are an open carry state and we DO cling to our guns AND our Bibles. Some more than others.

From your mouth to God’s ears. My Walther PPKs was stolen near 10 years ago while we were away....Have not been able to replace it as I was disabled due to disease. Figuring my best right now is a 12 gauge Mossberg or similar. Have to do some searching for inexpensive shotguns. Went from 90 grand a year to 28 grand a year over night..expenses stayed the same. Have a really nice home brew potato cannon :)

Rather than define a particular crime, why not simply specify that an attempt to detain someone for the purpose of enforcing a facially-invalid statute shall be regarded as kidnapping; people have the same right to resist as they would any other kidnapping, and the kidnapper, if he survives, shall be subject to prosecution like any other. Since enforcement of facially-illegitimate statutes is by definition illegitimate, and since illegitimate actions can by definition form no part of a government official's legitimate duties, there would be no basis for Texas to release the official in question for federal [non-]prosecution.
