I recall from my job in a gun store many years ago that Federal law gives the dealer broad discretion in refusing to sell to anyone if the transaction just doesn’t “feel right”.

That is likely enough wiggle-room to get them out of the lawsuits.

Yes, they will probably get out of any lawsuits by purchasers but from the article it sounds like they have exposure on the distributorship contract.

Dick Dick's before they dick you!

True, but they didn't refuse the sale, they refused to complete the contract they'd already agreed too.

Personally, I hope everyone who ordered from them but didn't received their merchandise AND the gun manufacturer that made the exclusive deal with them ALL sue them into nonexistence for breach of contract.

Dick's Sporting Goods is aptly named...particularly since they so obviously just stepped on their own!

But did you take their money first? Weeks in advance?

I’d say it’s breach of contract.

You are right - and wrong.

They completed the SALE of the weapons; they violated their duty to perform the CONTRACTED delivery of the purchase.

Not usually a supporter of lawsuits, but this one is righteous, and Dick's should be socked for full price plus fees plus treble damages. Make their liberal politics expensive!

I had an FFL in the mid-1990’s. I was told by an ATF agent during a “random” inspection that I could refuse to sell a firearm to anyone “for any reason or no reason.”
